BILL NUMBER: S8594 SPONSOR: BROUK TITLE OF BILL: An act to amend the social services law, in relation to including care and services of school psychologists under standard coverage for Medi- caid recipients PURPOSE: To provide Medicaid coverage of services and care provided by certified school psychologists. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill creates a new paragraph (mm) to provide Medicaid coverage for care and services provided by school psychologists certi- fied or otherwise authorized to provide such care and services within their scope of practice under the education law. Section two provides the effective date.

BROUK -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to including care and services of school psychologists under standard coverage for Medi- caid recipients THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 365-a of the social services law is amended by adding a new paragraph (mm) to read as follows: (MM) CARE AND SERVICES PROVIDED BY SCHOOL PSYCHOLOGISTS CERTIFIED, OR OTHERWISE AUTHORIZED TO PROVIDE SUCH CARE AND SERVICES WITHIN THEIR SCOPE OF PRACTICE, UNDER THE EDUCATION LAW WHERE SUCH SERVICES AND CARE WOULD OTHERWISE BE COVERED UNDER THIS TITLE. NOTHING IN THIS PARAGRAPH SHALL BE CONSTRUED TO MODIFY OR EXPAND THE SCOPE OF PRACTICE OF A SCHOOL PSYCHOLOGIST CERTIFIED, OR OTHERWISE AUTHORIZED TO PROVIDE SUCH CARE AND SERVICES UNDER THE EDUCATION LAW. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
