BILL NUMBER: S8623 SPONSOR: FELDER TITLE OF BILL: An act to amend the penal law, in relation to requiring every case of an injury arising from or caused by a bicycle with electric assist, an electric scooter or a limited use motorcycle to be reported at once to the police authorities of the city, town or village where the person reporting is located PURPOSE: Report to police the injuries and deaths caused by E-Bikes, E-scooters, and Mopeds, and better record such data SUMMARY OF PROVISIONS: Section 1 amends the penal law by adding a new section 265.27 that would require every case of an injury from or caused by a bicycle with elec- tric assist, an electric scooter or a limited use motorcycle to be reported at once to the police authorities of the city, town or village

FELDER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to requiring every case of an injury arising from or caused by a bicycle with electric assist, an electric scooter or a limited use motorcycle to be reported at once to the police authorities of the city, town or village where the person reporting is located THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 265.27 to read as follows: § 265.27 CERTAIN INJURIES TO BE REPORTED. EVERY CASE OF AN INJURY ARISING FROM OR CAUSED BY A BICYCLE WITH ELEC- TRIC ASSIST AS DEFINED IN SECTION ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW, AN ELECTRIC SCOOTER AS DEFINED IN SECTION ONE HUNDRED FOUR- TEEN-E OF THE VEHICLE AND TRAFFIC LAW OR A LIMITED USE MOTORCYCLE AS DEFINED IN SECTION ONE HUNDRED TWENTY-ONE-B OF THE VEHICLE AND TRAFFIC LAW, SHALL BE REPORTED AT ONCE TO THE POLICE AUTHORITIES OF THE CITY, TOWN OR VILLAGE WHERE THE PERSON REPORTING IS LOCATED BY: (A) THE PHYSI- CIAN ATTENDING OR TREATING THE CASE; OR (B) THE MANAGER, SUPERINTENDENT OR OTHER PERSON IN CHARGE, WHENEVER SUCH CASE IS TREATED IN A HOSPITAL, SANITARIUM OR OTHER INSTITUTION. FAILURE TO MAKE SUCH REPORT IS A CLASS A MISDEMEANOR. § 2. This act shall take effect immediately.
