TITLE OF BILL:

An act to amend the insurance law, in relation to requiring certain
insurance policies to provide coverage for neuropsychological exams for
children with pediatric cancers which affect brain development or func-
tion

 
PURPOSE:

To require insurers to cover comprehensive neuropsychological exams for
individuals who are diagnosed with pediatric cancers or brain tumors.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 establishes a title for the act.

Section 2 amends section 3216 of the insurance law by requiring that
insurance policies provide coverage for neuropsychological evaluations
for young people with pediatric cancer or brain tumors.

Section 3 amends section 3221 the insurance law by requiring that large
group policies provide coverage for neuropsychological evaluations for
dependents with pediatric cancers or brain tumors.

Section 4 amends section 4303 of the insurance law by requiring that
large group contracts issued by a hospital services corporation provide
coverage for neuropsychological evaluations for dependents with pedia-
tric cancers or brain tumors.

Section 5 sets forth the effective date.

 
JUSTIFICATION:

Each year close to 16,000 children are diagnosed with pediatric
cancer(1) and 5,000 children are diagnosed with pediatric brain
tumors(2). Because of the location of tumors, as well as the required
treatments of surgery, radiation and chemotherapy, very often pediatric
brain tumors and cancers can cause significant long-term impairment to
intellectual and neurological function3. The majority of children and
adolescents who are diagnosed with these diseases will survive into
adulthood, so it is essential that they receive comprehensive evalu-
ations to identify the appropriate interventions and services that they
need4.

However, lack of access to appropriate evaluations presents a barrier to
comprehensively serving children with pediatric brain tumors and
cancers. Comprehensive neuropsychological exams are the most appropriate
assessment for understanding the effects of the tumor and/or cancer and
treatment on the young person's memory, language, executive function,
emotional state and identifying the accommodations and interventions the
child needs. These exams are often administered over the course of
multiple days and cost thousands of dollars but are typically not
covered by health insurance, making them unaffordable for most families,
despite their importance for identifying the appropriate services.


This bill will provide insurance coverage for individuals under the age
of twenty-sixwho need neuropsychological examinations in accordance with
their diagnosis of pediatric cancer or brain tumor.  It will allow indi-
viduals to get coverage for the evaluation that they need.

EFFECTIVE DATE:
This act shall take effect on the first of January next succeeding the
date when it shall become a law.

 AN ACT to amend the insurance law,  in  relation  to  requiring  certain
   insurance  policies  to  provide coverage for neuropsychological exams
   for children with pediatric cancers which affect brain development  or
   function

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Short title. This act shall be known and may  be  cited  as
 the "pediatric cancer neuropsychological needs assessment act".
   § 2. Subsection (i) of section 3216 of the insurance law is amended by
 adding a new paragraph 39 to read as follows:
   (39)  EVERY  POLICY  THAT  PROVIDES  MEDICAL, MAJOR MEDICAL OR SIMILAR
 COMPREHENSIVE-TYPE COVERAGE SHALL  PROVIDE  COVERAGE  FOR  COMPREHENSIVE
 EVALUATIONS  FOR  INDIVIDUALS UP TO AGE TWENTY-SIX WITH PEDIATRIC CANCER
 OR BRAIN TUMORS, AND SHALL NOT EXCLUDE COVERAGE FOR THE SCREENING, DIAG-
 NOSIS OR TREATMENT OF MEDICAL CONDITIONS OTHERWISE COVERED BY SUCH POLI-
 CY.  SUCH COVERAGE SHALL INCLUDE COMPREHENSIVE NEUROPSYCHOLOGICAL  EXAM-
 INATIONS  IN  ACCORDANCE  WITH EVIDENCE-BASED MEDICAL LITERATURE FOR THE
 PURPOSES OF IDENTIFYING MEMORY, LANGUAGE, AND EXECUTIVE  FUNCTION  CHAL-
 LENGES  AND  DETERMINING  THE  PSYCHOLOGICAL, EMOTIONAL, AND EDUCATIONAL
 WELLNESS NEEDS OF THE INDIVIDUAL TESTED.
   § 3. Subsection (l) of section 3221 of the insurance law is amended by
 adding a new paragraph 22 to read as follows:
   (22) EVERY LARGE GROUP POLICY THAT PROVIDES MEDICAL, MAJOR MEDICAL  OR
 SIMILAR  COMPREHENSIVE-TYPE  COVERAGE SHALL PROVIDE COVERAGE FOR COMPRE-
 HENSIVE EVALUATIONS FOR INDIVIDUALS UP TO AGE TWENTY-SIX WITH  PEDIATRIC
 CANCER  OR  BRAIN TUMORS, AND SHALL NOT EXCLUDE COVERAGE FOR THE SCREEN-
 ING, DIAGNOSIS OR TREATMENT OF MEDICAL CONDITIONS OTHERWISE  COVERED  BY
 SUCH  POLICY. SUCH COVERAGE SHALL INCLUDE COMPREHENSIVE NEUROPSYCHOLOGI-
 CAL EXAMINATIONS IN ACCORDANCE WITH  EVIDENCE-BASED  MEDICAL  LITERATURE
 FOR THE PURPOSES OF IDENTIFYING MEMORY, LANGUAGE, AND EXECUTIVE FUNCTION
 CHALLENGES AND DETERMINING THE PSYCHOLOGICAL, EMOTIONAL, AND EDUCATIONAL
 WELLNESS NEEDS OF THE INDIVIDUAL TESTED.

   §  4.  Section  4303  of  the insurance law is amended by adding a new
 subsection (vv) to read as follows:
   (VV)  EVERY  LARGE GROUP CONTRACT ISSUED BY A HOSPITAL SERVICES CORPO-
 RATION OR A HEALTH SERVICES CORPORATION  THAT  PROVIDES  MEDICAL,  MAJOR
 MEDICAL  OR  SIMILAR  COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE COVERAGE
 FOR COMPREHENSIVE EVALUATIONS FOR INDIVIDUALS UP TO AGE TWENTY-SIX  WITH
 PEDIATRIC CANCER OR BRAIN TUMORS, AND SHALL NOT EXCLUDE COVERAGE FOR THE
 SCREENING,  DIAGNOSIS  OR  TREATMENT  OF  MEDICAL  CONDITIONS  OTHERWISE
 COVERED BY  SUCH  POLICY.  SUCH  COVERAGE  SHALL  INCLUDE  COMPREHENSIVE
 NEUROPSYCHOLOGICAL   EXAMINATIONS   IN  ACCORDANCE  WITH  EVIDENCE-BASED
 MEDICAL LITERATURE FOR THE PURPOSES OF IDENTIFYING MEMORY, LANGUAGE, AND
 EXECUTIVE  FUNCTION  CHALLENGES  AND  DETERMINING   THE   PSYCHOLOGICAL,
 EMOTIONAL, AND EDUCATIONAL WELLNESS NEEDS OF THE INDIVIDUAL TESTED.
   §  5. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law and shall apply to  all
 policies issued, modified or renewed on and after such effective date.
