BILL NUMBER: S892 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring that certain motor vehicles shall be equipped with operable carbon monoxide detectors PURPOSE: To require that every for hire vehicle operated or driven upon the public highways of the state with a chassis which, was manufactured and then altered for the purpose of transporting ten or more occupants, including the driver be equipped with an operable carbon monoxide detec- tor. HOYLMAN, KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring that certain motor vehicles shall be equipped with operable carbon monoxide detectors THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 9 of section 375 of the vehicle and traffic law, as amended by chapter 576 of the laws of 1985, is amended to read as follows: 9. A. Every omnibus operating upon the public highways of the state having a carrying capacity of ten or more passengers, shall be equipped with one hand fire extinguisher of at least 4 B:C Underwriters' Labora- tories rating or a similar rating by any qualified laboratory or testing organization which meets the criteria of American Society for Testing Materials test E548-76. Fire extinguishers shall be kept in good operat- ing condition at all times and must be mounted in a place readily acces- sible for use. B. EVERY FOR HIRE VEHICLE OPERATED OR DRIVEN UPON THE PUBLIC HIGHWAYS OF THE STATE WITH A CHASSIS WHICH WAS MANUFACTURED AND THEN ALTERED FOR THE PURPOSE OF TRANSPORTING TEN OR MORE OCCUPANTS, INCLUDING THE DRIVER, SHALL BE EQUIPPED WITH AN OPERABLE CARBON MONOXIDE DETECTOR. THE COMMIS- SIONER, IN CONSULTATION WITH THE COMMISSIONER OF TRANSPORTATION, SHALL PROMULGATE RULES AND REGULATIONS AS HE OR SHE SHALL DEEM NECESSARY TO CARRY OUT THE PROVISIONS OF THIS PARAGRAPH. § 2.
