BILL NUMBER: S8982 SPONSOR: SCARCELLA-SPANTON TITLE OF BILL: An act to amend the executive law, in relation to the definition of caregiver for purposes of authorizing criminal history checks PURPOSE OR GENERAL IDEA OF BILL: This bill would expand the ability for certain employers to request a caregiver to provide fingerprints for the purposes of a background check. SUMMARY OF PROVISIONS: Section 1 of the bill relates to changing the definition of a caregiver for the purpose of authorizing a criminal background check. Section 2 of the bill relates to the effective date.

SCARCELLA-SPANTON -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the executive law, in relation to the definition of caregiver for purposes of authorizing criminal history checks THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 837-n of the executive law, as added by chapter 3 of the laws of 1998, is amended to read as follows: (a) "Caregiver" shall mean a person employed to provide [fifteen or more hours of] care [per week] to a child or children in the home of such a child or children. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04706-01-3
