BILL NUMBER: S9159 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the public health law, in relation to requiring feder- ally qualified health centers and rural health centers cover the cost of all ovulation enhancing drugs dispensed PURPOSE: To ensure that the cost of ovulation enhancing drugs are included in the calculation of the alternative payment reimbursement methodology for federally qualified health centers and rural health clinics related to the carveout of the pharmacy benefit from managed care to fee-for-ser- vice SUMMARY OF PROVISIONS: Section 1: Amends section 2807 of the Public Health Law by adding a new paragraph to require the inclusion of ovulation enhancing drugs in the Department of Health's calculation of alternative reimbursement method-

FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring feder- ally qualified health centers and rural health centers cover the cost of all ovulation enhancing drugs dispensed THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 2807 of the public health law is amended by adding a new paragraph (g) to read as follows: (G) THE DEPARTMENT IN DEVELOPING AND REVISING AN ALTERNATIVE PAYMENT METHODOLOGY FOR FEDERALLY QUALIFIED HEALTH CENTERS AND RURAL HEALTH CLINICS PURSUANT TO SECTION ONE OF PART FFF OF CHAPTER FIFTY-SIX OF THE LAWS OF TWO THOUSAND TWENTY, AS AMENDED BY SECTION ONE OF PART C OF CHAPTER FIFTY-SEVEN OF THE LAWS OF TWO THOUSAND TWENTY-ONE, FOR SUCH COVERED ENTITIES AS DEFINED IN SECTION 340B OF THE FEDERAL PUBLIC HEALTH SERVICE ACT, 42 USC § 256B, FOR DRUGS THAT WOULD OTHERWISE BE ELIGIBLE FOR PRICING UNDER SECTION 340B OF THE FEDERAL PUBLIC HEALTH SERVICE ACT, SHALL ALSO INCLUDE THE COST OF ALL OVULATION ENHANCING DRUGS DISPENSED BY SUCH COVERED ENTITIES. § 2.
