Permits the legislature to alter or repeal certain educational institutions' tax exempt status if such higher education institution fails to expel, suspend, bring charges of a hate crime or otherwise appropriately apply disciplinary action against any individual or group who knowingly and intentionally, while using the property or other resources of such institution, establishes a culture of bias or promotes acts of discrimination or allows for the reckless endangerment of an individual's physical health or safety.

BILL NUMBER: S9169 SPONSOR: MURRAY TITLE OF BILL: An act to amend the real property tax law, in relation to permitting the legislature to alter or repeal certain private educational institutions' tax exempt status PURPOSE: The purpose of this bill is to permit the Legislature to alter or repeal the property tax exempt status of any private educational institution of higher learning in certain circumstances. MURRAY, GRIFFO, OBERACKER, ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the real property tax law, in relation to permitting the legislature to alter or repeal certain private educational insti- tutions' tax exempt status THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 420-a of the real property tax law is amended by adding a new paragraph (c) to read as follows: (C) NOTWITHSTANDING THE PROVISIONS OF THIS SECTION, THE LEGISLATURE MAY ALTER OR REPEAL SUCH TAX EXEMPT STATUS OF ANY PRIVATE EDUCATIONAL INSTITUTION OF HIGHER LEARNING THAT FAILS TO EXPEL, SUSPEND, OR BRING CHARGES OF A HATE CRIME UNDER SECTION 485.05 OF THE PENAL LAW, OR OTHER- WISE APPROPRIATELY APPLY DISCIPLINARY ACTION AGAINST ANY INDIVIDUAL OR GROUP WHO KNOWINGLY AND INTENTIONALLY, WHILE USING THE PROPERTY OR OTHER RESOURCES OF SUCH INSTITUTION, ESTABLISHES A CULTURE OF BIAS OR PROMOTE ACTS OF DISCRIMINATION OR ALLOWS FOR THE RECKLESS ENDANGERMENT OF THE PHYSICAL HEALTH OR SAFETY OF ANY OF THEIR EMPLOYEES, STUDENTS, OFFICERS OF SUCH INSTITUTION, CLIENTS OF SUCH INSTITUTION, OR VISITORS OR OTHER LICENSEES USING SUCH TAX EXEMPT PROPERTY OR OTHER RESOURCES. § 2. This act shall take effect on the same date as a concurrent resolution amending the constitution, entitled "CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 1 of article 16 of the constitution, in relation to real property tax exemptions for certain educational institutions", takes effect.
