BILL NUMBER: S9216 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the education law, in relation to requirements for licensure as a dentist PURPOSE: The purpose of this bill is to provide a near-term boost to the pool of dentists practicing in underserved areas while also providing a viable pathway to licensure for qualified dentists from other jurisdictions who seek to work in New York in the field of public health dentistry. SUMMARY OF PROVISIONS: Section 1: amends subdivision three of section 6604 of the education law to expand the "experience" standard to authorize experienced dentists licensed in other jurisdictions to be licensed in New York by completing a minimum of one year of either (i) full-time faculty membership at an approved New York state school of dentistry or (ii) full-time experi-

STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to requirements for licensure as a dentist THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 6 of section 6604 of the education law, subdivision 3 as amended by chapter 613 of the laws of 2022 and subdivi- sion 6 as amended by chapter 669 of the laws of 2022, are amended to read as follows: (3) Experience: have experience satisfactory to the board and in accordance with the commissioner's regulations, provided that: (A) such experience shall consist of satisfactory completion of a postdoctoral general practice or specialty dental residency program, of at least one year's duration, in a hospital or dental facility accred- ited for teaching purposes by a national accrediting body approved by the department, provided, further that any such residency program shall include a formal outcome assessment evaluation of the resident's compe- tence to practice dentistry acceptable to the department; OR (B) NOTWITHSTANDING PARAGRAPH (A) OF THIS SUBDIVISION, FOR AN APPLI- CANT WITH A MINIMUM OF THREE YEARS OF FULL-TIME DENTAL PRACTICE EXPERI- ENCE, OR THE EQUIVALENT THEREOF, WITHIN THE FIVE YEARS IMMEDIATELY PRECEDING THE APPLICANT'S APPLICATION AND IN THE STATE OR COUNTRY FROM WHICH SUCH APPLICANT RECEIVED A LICENSE TO PRACTICE DENTISTRY, SUCH EXPERIENCE MAY CONSIST OF SATISFACTORY COMPLETION OF A MINIMUM OF ONE YEAR OF EITHER: (I) EXPERIENCE AS A FULL-TIME FACULTY MEMBER EMPLOYED AT AN APPROVED NEW YORK STATE SCHOOL OF DENTISTRY, OR (II) FULL-TIME EXPERIENCE, OR THE EQUIVALENT THEREOF, AS A GENERAL PRACTICE DENTAL PRECEPTEE IN A PRECEPTORSHIP PROGRAM UNDER THE SUPERVISION OF A LICENSED DENTIST IN AN AREA WHICH HAS BEEN DESIGNATED A FEDERAL DENTAL HEALTH PROFESSIONS SHORTAGE AREA, PROVIDED FURTHER THAT THE LICENSED DENTIST WHO SUPERVISES SUCH A PRECEPTEE SHALL BE DESIGNATED THE PRECEP- TOR DENTIST, HAVE PRACTICED FOR AT LEAST FIVE YEARS IMMEDIATELY PRECED- ING ASSUMING A PRECEPTORSHIP, AND HAVE UNDER HIS OR HER SUPERVISION NOT EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
