BILL NUMBER: S9257 SPONSOR: BRESLIN TITLE OF BILL: An act to amend the executive law and the legislative law, in relation to education and training in ethics and lobbying PURPOSE:: To allow the Commission on Ethics and Lobbying in Government to impose a fee for failure to complete required training sessions and requires registered clients to complete training as well. SUMMARY OF PROVISIONS:: Section 1 amends the Executive Law by adding a new paragraph to subdivi- sion 8 of section 94 allowing COELIG to impose a fee of up to $25 for failure by lobbyists or their clients to complete their mandatory train- ing. BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Ethics and Internal Gover- nance AN ACT to amend the executive law and the legislative law, in relation to education and training in ethics and lobbying THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 94 of the executive law is amended by adding a new paragraph (d-1) to read as follows: (D-1) THE COMMISSION MAY IMPOSE A FEE UPON LOBBYISTS AND CLIENTS OF LOBBYISTS FOR LATE COMPLETION OF THE TRAINING COURSE REQUIRED BY THIS SUBDIVISION, AS SET FORTH IN SUBDIVISION (I) OF SECTION ONE-D OF THE LEGISLATIVE LAW. § 2. Subdivision (h) of section 1-d of the legislative law, as added by section 7 of part A of chapter 399 of the laws of 2011, is amended and a new subdivision (i) is added to read as follows: (h) provide an online ethics training course for [individuals regis- tered as] lobbyists AND CLIENTS LISTED ON A STATEMENT OF REGISTRATION SUBMITTED pursuant to section one-e of this article. The curriculum for the course shall include, but not be limited to, explanations and discussions of the statutes and regulations of New York concerning ethics in the public officers law, the election law, the legislative law, summaries of advisory opinions, underlying purposes and principles of the relevant laws, and examples of practical application of these laws and principles. The commission shall prepare those methods and materials necessary to implement the curriculum. Each [individual regis- tered as a] lobbyist [pursuant to section one-e of this article] AND CLIENT shall complete such training course WITHIN NINETY DAYS OF BEING LISTED ON A STATEMENT OF REGISTRATION AND THEREAFTER at least once in any [three-year] BIENNIAL period during which [he or she is registered as a] THE lobbyist OR CLIENT IS LISTED ON A STATEMENT OF REGISTRATION SUBMITTED PURSUANT TO SECTION ONE-E OF THIS ARTICLE. (I) THE COMMISSION MAY IMPOSE A FEE FOR FAILURE TO COMPLETE THE TRAIN- ING COURSE IN A TIMELY MANNER AS REQUIRED BY THIS SECTION, NOT TO EXCEED EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
