BILL NUMBER: S9284 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the general business law, in relation to requiring rental vehicles have any personal information removed from the vehicle once returned PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to have any information uploaded to a vehicle by a renter to be removed once the vehicle is returned. SUMMARY OF PROVISIONS: Section one of the bill amends section 391-r of the general business law by adding a new section that requires all persons, firms, partnerships, associations, or corporations that provide rental vehicles shall delete all personal information of the customer from the vehicle upon its return.

KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to requiring rental vehicles have any personal information removed from the vehicle once returned THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 391-r to read as follows: § 391-R. PERSONAL INFORMATION ON RENTAL VEHICLES. ANY PERSON, FIRM, PARTNERSHIP, ASSOCIATION OR CORPORATION ENGAGED IN THE BUSINESS OF RENT- ING MOTOR VEHICLES SHALL, UPON RECEIPT OF A RENTAL VEHICLE FROM A CUSTOMER, REMOVE ALL PERSONAL INFORMATION FROM SUCH VEHICLE RELATING TO THE CUSTOMER. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14886-01-4

BILL NUMBER: S9284A SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the general business law, in relation to personal infor- mation being removed from rental vehicles PURPOSE OR GENERAL IDEA OF BILL:: The purpose of the bill is to include in a rental agreement that any information uploaded to a vehicle by a renter, must be removed prior to returning the vehicle. SUMMARY OF PROVISIONS:: Section 1: Section 396-z of the general business law is amended by adding a new subdivision 17 that requires all rental vehicle companies to include a clause, within rental agreements, that instructs all renters to remove their personal information from vehicles before returning them and allows the option to place a decal within the vehicle that reminds renters of this clause.

Section 396-z of the general business law is amended by adding a new subdivision 17 to read as follows: 17. A RENTAL VEHICLE COMPANY SHALL: (A) INCLUDE IN THE CAR RENTAL AGREEMENT A CLAUSE INSTRUCTING THE RENTER TO REMOVE THEIR PERSONAL INFORMATION FROM VEHICLES BEFORE RETURN- ING THE VEHICLE. (B) HAVE THE OPTION TO PLACE INSIDE ALL RENTAL VEHICLES A DECAL INSTRUCTING RENTERS TO REMOVE THEIR PERSONAL INFORMATION FROM THE VEHI- CLE BEFORE RETURNING THE VEHICLE. § 2. This act shall take effect on the thirtieth day after it shall have become a law; provided however that the amendments to section 396-z of the general business law made by section one of this act shall survive the expiration and reversion of such section as provided in subdivision (a) of section 4 of chapter 109 of the laws of 2018, as amended.
