BILL NUMBER: S9324 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the education law, in relation to prohibiting libraries and library systems from banning books or other materials based on partisan or doctrinal disapproval PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to prohibit libraries and library systems from banning books or other materials based on partisan or doctrinal disapproval SUMMARY OF PROVISIONS: Section one adds Section 286 to the education law to prohibit libraries and library systems from proscribing, banning, or removing any books or other materials because of partisan or doctrinal disapproval. Section two sets an immediate effective date.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Libraries AN ACT to amend the education law, in relation to prohibiting libraries and library systems from banning books or other materials based on partisan or doctrinal disapproval THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 286 to read as follows: § 286. PROHIBITION ON BOOK BANNING. NO LIBRARY, OR LIBRARY SYSTEM ESTABLISHED OR OPERATING UNDER THIS ARTICLE, INCLUDING SCHOOL LIBRARIES AND SCHOOL LIBRARY SYSTEMS, SHALL PROSCRIBE, BAN, OR REMOVE ANY BOOKS OR OTHER MATERIALS BECAUSE OF PARTISAN OR DOCTRINAL DISAPPROVAL. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13349-01-3
