BILL NUMBER: S9487 SPONSOR: COONEY TITLE OF BILL: An act to amend the cannabis law, in relation to cannabinoid hemp and hemp extract SUMMARY OF SPECIFIC PROVISIONS: Section 1: Makes changes to section 103 of the cannabis law to set TEC thresholds for an orally consumed product in the form of a beverage and containing cannabinoids derived only from hemp and prohibits such prod- uct with .5 milligrams or greater of total THC from being sold to indi- viduals under twenty-one years of age. COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the cannabis law, in relation to cannabinoid hemp and hemp extract THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 103 of the cannabis law is amended by adding two new subdivisions 4 and 5 to read as follows: 4. NOTWITHSTANDING ANY LAW, RULE, OR REGULATION, AN ORALLY CONSUMED PRODUCT IN THE FORM OF A BEVERAGE AND CONTAINING CANNABINOIDS DERIVED ONLY FROM HEMP, INCLUDING CANNABINOID HEMP OR HEMP EXTRACT: (A) MAY CONTAIN UP TO FIVE MILLIGRAMS OF TOTAL DELTA-9 TETRAHYDROCAN- NABINOL CONCENTRATION (THC) PER CONTAINER; (B) MAY CONTAIN, SUBJECT TO THE FIVE MILLIGRAM OF TOTAL THC CONTAINER LIMIT IN PARAGRAPH (A) OF THIS SUBDIVISION, UP TO FIVE MILLIGRAMS OF TOTAL THC PER SERVING; AND (C) IS NOT REQUIRED TO CONTAIN A RATIO OF ANY NON-THC CANNABINOID, INCLUDING BUT NOT LIMITED TO CANNABIDIOL (CBD), TO THC PER SERVING OR CONTAINER. 5. NOTWITHSTANDING ANY LAW, RULE, OR REGULATION, ANY ORALLY CONSUMED PRODUCT IN THE FORM OF A BEVERAGE AND CONTAINING CANNABINOIDS DERIVED ONLY FROM HEMP, INCLUDING CANNABINOID HEMP OR HEMP EXTRACT, WITH .5 MILLIGRAMS OR GREATER OF TOTAL THC PER CONTAINER MAY NOT BE SOLD TO INDIVIDUALS UNDER TWENTY-ONE YEARS OF AGE. § 2.
