TITLE OF BILL:

An act to amend the state finance law, in relation to permitting the
state and local municipalities to purchase from sources other than the
correctional industries program of the department of corrections and
community supervision

 
PURPOSE:

To provide procurement flexibility to state and local entities by remov-
ing the mandate they purchase certain commodities from the Correctional
Industries Program ("Corcraft") of the Department of Corrections and
Community Supervision.

 
SUMMARY OF PROVISIONS:

Section 1 - Amends Section 162 of the State Finance Law, removing the
requirement that state agencies, public authorities, commissions, public
benefit corporations, and political subdivisions must purchase certain

commodities from Corcraft

Section 2 - Effective Date

 
JUSTIFICATION:

Given its first priority status amongst preferred sources for state and
local procurement purposes, Corcraft has experienced tremendous control
over the public market that must buy the commodities it produces as long
as an entity's needs for form, function, and utility are met. While
purchasing efficiencies may exist due to buyers not having to follow the
competitive bid process, the overall finances, benefits, success, and
value of the Correctional Industries Program remain dubious to say the
least (especially regarding the interests of incarcerated laborers and
taxpayers). Removing the mandate required of our state agencies, as well
as its public benefit corporations and political subdivisions, to buy
commodities from Corcraft would provide these entities with greater
authority and flexibility to seek the best deal possible for many every-
day items currently compelled to be purchased from the Correctional
Industries Program. However, should these same entities choose to
continue purchasing items directly from Corcraft, the expedited option
would be preserved.

   printed to be committed to the Committee on Procurement and Contracts
 
 AN ACT to amend the state finance law, in  relation  to  permitting  the
   state and local municipalities to purchase from sources other than the
   correctional  industries  program of the department of corrections and
   community supervision

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subparagraph (i) of paragraph a of subdivision 4 of section
 162  of the state finance law, as amended by section 164 of subpart B of
 part C of chapter 62 of the laws of 2011, is amended to read as follows:
   (i) When commodities are available, in the form, function and  utility
 required by a state agency, public authority, commission, public benefit
 corporation  or  political  subdivision,  said commodities [must] MAY be
 purchased first from the correctional industries program of the  depart-
 ment of corrections and community supervision;
   § 2. This act shall take effect immediately.
