BILL NUMBER: S9611 SPONSOR: MAYER TITLE OF BILL: An act to amend the labor law, in relation to the payment of prevailing wage for work involving the delivery and hauling of aggregate supply construction materials PURPOSE OF BILL: The purpose of this bill is to clarify the definition of "aggregate supply construction materials" in Section 220 of the Labor Law relating to work performed on a public works worksite in the counties of Nassau, Suffolk, and Westchester, for any work involving the delivery to and hauling from such worksites of aggregate supply construction materials. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends paragraph f of subdivision 3-a of section 220 of the labor law to define "aggregate supply construction materials" to include concrete and asphalt in addition to sand, gravel, stone,

MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to the payment of prevailing wage for work involving the delivery and hauling of aggregate supply construction materials THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph f of subdivision 3-a of section 220 of the labor law, as amended by chapter 119 of the laws 2022, is amended to read as follows: f. Prevailing wage shall be paid for work performed on a public works worksite pursuant to this section for any work involving the delivery to and hauling from such worksites of aggregate supply construction materi- als, as well as any return hauls, whether empty or loaded and any time spent loading/unloading. FOR PURPOSES OF THIS PARAGRAPH, IN THE COUN- TIES OF NASSAU, SUFFOLK, AND WESTCHESTER, "AGGREGATE SUPPLY CONSTRUCTION MATERIALS" SHALL INCLUDE CONCRETE AND ASPHALT IN ADDITION TO SAND, GRAV- EL, STONE, CRUSHED STONE, DIRT, SOIL, MILLINGS, AND FILL. § 2.
