BILL NUMBER: S9684 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the public officers law, in relation to waiving the residency requirement for the commissioner of health and public health director for Putnam county PURPOSE OR GENERAL IDEA OF BILL: Waives the residency requirement for the commissioner of health and public health director for Putnam county. SUMMARY OF PROVISIONS: Section 1 amends Public Officers Law section 3 by adding new subdivision 75, waiving the requirement for the Putnam Commissioner of Health and Public Health Director to reside in the political subdivision or munici- pal corporation of the state for which such person shall be chosen or within which such person's official functions are required to be exer- cised, and merely requiring that such persons reside in Putnam County or

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to waiving the residency requirement for the commissioner of health and public health director for Putnam county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the public officers law is amended by adding a new subdivision 75 to read as follows: 75. IN THE COUNTY OF PUTNAM, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN WHICH SUCH PERSON'S OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF COMMISSIONER OF HEALTH AND THE PUBLIC HEALTH DIRECTOR OF THE COUNTY OF PUTNAM, PROVIDED THAT SUCH PERSON RESIDES IN PUTNAM COUNTY OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK; PROVIDED, HOWEVER THAT ANY PERSON PERFORMING SUCH FUNCTIONS OR HOLDING THE OFFICE OF COMMISSIONER OF HEALTH AND PUBLIC HEALTH DIRECTOR IN ANY OTHER COUNTY SHALL BE A RESIDENT OF SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW. § 2.
