 Introduced  by  Sen.  MANNION  --  (at  request  of  the  State Board of
   Elections) -- read twice and ordered printed, and when printed  to  be
   committed to the Committee on Elections
 
 AN  ACT  to  amend  the election law, in relation to accessible absentee
   ballots
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Subdivision  3  of  section  8-400 of the election law is
 amended by adding a new paragraph (e) to read as follows:
   (E) SUCH APPLICATION SHALL PERMIT AN APPLICANT WITH A DISABILITY  THAT
 INTERFERES  WITH THE EFFECTIVE READING, WRITING, OR USE OF PRINTED MATE-
 RIAL TO APPLY FOR AN ACCESSIBLE  ABSENTEE  BALLOT  AS  PROVIDED  FOR  IN
 SECTION 8-405 OF THIS TITLE.
   §  2.  The election law is amended by adding new section 8-405 to read
 as follows:
   § 8-405. ACCESSIBLE ABSENTEE BALLOTS.   1. VOTERS  WITH  A  DISABILITY
 THAT  INTERFERES  WITH THE EFFECTIVE READING, WRITING, OR USE OF PRINTED
 MATERIAL WHO APPLY FOR AN ACCESSIBLE ABSENTEE BALLOT AND  ARE  OTHERWISE
 ELIGIBLE  TO  RECEIVE  AN  ABSENTEE  BALLOT  SHALL BE SENT AN ACCESSIBLE
 ABSENTEE BALLOT BY ACCESSIBLE ELECTRONIC  SYSTEM.    SUCH  SYSTEM  SHALL
 ALLOW  SUCH  VOTER  TO DOWNLOAD AN ACCESSIBLE ABSENTEE BALLOT, MARK SUCH
 BALLOT PRIVATELY AND INDEPENDENTLY  USING  SUCH  VOTER'S  OWN  ASSISTIVE
 TECHNOLOGY, AND PRINT SUCH VOTER'S MARKED BALLOT.
   2.  SUCH  ACCESSIBLE  ABSENTEE BALLOTS SHALL BE RETURNED, COUNTED, AND
 CANVASSED AS PROVIDED IN THIS CHAPTER FOR OTHER ABSENTEE VOTERS' BALLOTS
 AND ALL PROVISIONS OF THIS CHAPTER, NOT INCONSISTENT WITH THIS  SECTION,
 SHALL APPLY.
   § 3. Subdivision 4 of section 8-400 of the election law, as amended by
 chapter 63 of the laws of 2010, is amended to read as follows:
   4.  A  voter  who  claims permanent illness or physical disability may
 make application for an absentee ballot and  the  right  to  receive  an
 absentee  ballot for each election thereafter as provided herein without
 further application, by filing with the board of elections  an  applica-
 tion  which  shall contain a statement to be executed by the voter. SUCH
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
