 Introduced by Sen. SCARCELLA-SPANTON -- (at request of the Department of
   Veterans' Services) -- read twice and ordered printed, and when print-
   ed to be committed to the Committee on Consumer Protection
 
 AN  ACT  to amend the general business law, in relation to  compensation
   protection
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The section heading of section 349-f of the general busi-
 ness law, as added by chapter 183 of the laws of 2019,  is  amended  and
 subdivision  3  is  amended  by  adding  a  new paragraph (c) to read as
 follows:
   Pension poaching prevention AND COMPENSATION PROTECTION.
   (C) NO ENTITY SHALL ADVISE, ASSIST, OR ADVERTISE TO ANY PARTY  REGARD-
 ING  VETERANS'  BENEFITS  MATTERS  SPECIFICALLY RELATING TO CAMP LEJEUNE
 INJURIES WITHOUT CLEARLY PROVIDING,  AT  THE  OUTSET  OF  THIS  BUSINESS
 RELATIONSHIP,  THE FOLLOWING DISCLOSURE, BOTH ORALLY AND IN WRITING: "IN
 ACCORDANCE WITH THE CAMP LEJEUNE  JUSTICE  ACT  OF  2022  ANY  AWARD  OR
 SETTLEMENT  OBTAINED FROM A LAWSUIT AGAINST THE GOVERNMENT MAY RESULT IN
 AN OFFSET OF VA, MEDICARE, OR MEDICAID BENEFITS." THE PARTY MUST VERBAL-
 LY ACKNOWLEDGE UNDERSTANDING OF THE ORAL DISCLOSURE AND MUST PROVIDE HIS
 OR HER SIGNATURE TO REPRESENT UNDERSTANDING OF THESE PROVISIONS  ON  THE
 DOCUMENT  IN  WHICH  THE  WRITTEN  DISCLOSURE  APPEARS.  THE ENTITY MUST
 PROVIDE A COPY TO THE PARTY AND  MUST  RETAIN  A  COPY  OF  THE  WRITTEN
 DISCLOSURE  WHILE  ACTING  AS  LEGAL  REPRESENTATIVE  OF THE VETERAN FOR
 COMPENSATION AND FOR AT LEAST ONE YEAR AFTER  THE  DATE  ON  WHICH  THIS
 SERVICE RELATIONSHIP TERMINATES.
   § 2. This act shall take effect immediately.
