TITLE OF BILL:

An act to amend the New York city charter, in relation to opportunities
for special veteran emerging business enterprises

 
PURPOSE:

The purpose of this bill is to support veteran-owned businesses by
facilitating their participation in non-competitive procurement proc-
esses with New York City agencies.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1. Amends Section 311 of the New York City Charter to authorize
city agencies to procure goods, services, and construction up to
$1,500,000 from special veteran emerging business enterprises without a
formal competitive process. It further mandates that the Mayor's Office
of Contract Services develop criteria for the certification of these
businesses, ensuring they meet the necessary qualifications. Addi-

tionally, this section requires the inclusion of special veteran emerg-
ing business enterprises in the city's procurement databases and
resources to promote their visibility and accessibility to city agen-
cies.

Section 2. Requires an annual report to the governor and state legisla-
ture detailing the total number and value of such procurements.  The
report must also include information on the types of goods and services
procured, the participating agencies, and the overall impact on the
local economy. This requirement ensures transparency and accountability
in the implementation of the procurement process.

Section 3. Introduces a new paragraph 4 to subdivision i of section 311,
defining "special veteran emerging business enterprise" as a business
that is both a certified service-disabled veteran-owned business enter-
prise (SDVOB) and certified as an emerging business enterprise. The
certification process will align with existing state and federal stand-
ards to ensure consistency and reliability.

Section 4. Effective Date.

 
JUSTIFICATION:

This legislation aims to leverage New York City's substantial purchasing
power to benefit veteran business owners, particularly those certified
as service-disabled veteran-owned businesses (SDVOBs).  Supporting these
enterprises honors the service of veterans and aids in their economic
reintegration. By enabling non-competitive procurements, the bill
provides a significant advantage to veteran-owned businesses, helping
them overcome challenges in the procurement process and fostering
economic growth, job creation, and community development.

 AN ACT to amend the New York city charter, in relation to  opportunities
   for special veteran emerging business enterprises
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs 1 and 3 of subdivision i of section 311  of  the
 New York city charter, paragraph 1 as amended by chapter 110 of the laws
 of  2024  and paragraph 3 as amended by chapter 569 of the laws of 2022,
 are amended to read as follows:
   1. agencies may make procurements of goods, services and  construction
 for amounts not exceeding one million five hundred thousand dollars from
 businesses  certified  as  minority  or women-owned business enterprises
 pursuant to section thirteen  hundred  four  of  the  charter  AND  FROM
 SPECIAL  VETERAN  EMERGING BUSINESS ENTERPRISES without a formal compet-
 itive process.
   3. the rule or rules promulgated to implement paragraph  one  of  this
 subdivision  shall  provide that the city shall, commencing on the first
 of October of the first full calendar year  following  the  adoption  of
 such  rule  or  rules,  submit  an annual report to the governor and the
 state legislature of the total number and total dollar value of procure-
 ments of goods and services for amounts not exceeding the dollar  amount
 threshold  for  making procurements without a formal competitive process
 as established by rule pursuant to paragraph  one  of  this  subdivision
 from:
   (i)  businesses  certified  as minority or women-owned business enter-
 prises pursuant to section thirteen hundred four of the charter;
   (ii) SPECIAL VETERAN EMERGING BUSINESS ENTERPRISES;
   (III) all other businesses; and
   [(iii)] (IV) information about the number of businesses  certified  as
 minority  or  women-owned business enterprises pursuant to section thir-
 teen hundred four of this charter OR SPECIAL VETERAN  EMERGING  BUSINESS

 ENTERPRISES THAT ARE able to perform the specific type and scale of work
 involved in each procurement.
   §  2.  Subdivision  i  of  section 311 of the New York city charter is
 amended by adding a new paragraph 4 to read as follows:
   4. FOR PURPOSES OF THIS SUBDIVISION, THE TERM "SPECIAL VETERAN  EMERG-
 ING BUSINESS ENTERPRISE" MEANS A BUSINESS ENTERPRISE THAT IS A CERTIFIED
 SERVICE-DISABLED  VETERAN-OWNED BUSINESS ENTERPRISE AS DEFINED IN SUBDI-
 VISION ONE OF SECTION FORTY OF THE VETERANS' SERVICES LAW  AND  THAT  IS
 CERTIFIED  AS  AN EMERGING BUSINESS ENTERPRISE PURSUANT TO SECTION THIR-
 TEEN HUNDRED FOUR OF THE CHARTER.
   § 3. This act shall take effect immediately.
