BILL NUMBER: S9848 SPONSOR: SANDERS TITLE OF BILL: An act to amend the New York city charter, in relation to opportunities for special veteran emerging business enterprises PURPOSE: The purpose of this bill is to support veteran-owned businesses by facilitating their participation in non-competitive procurement proc- esses with New York City agencies. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends Section 311 of the New York City Charter to authorize city agencies to procure goods, services, and construction up to $1,500,000 from special veteran emerging business enterprises without a formal competitive process. It further mandates that the Mayor's Office of Contract Services develop criteria for the certification of these businesses, ensuring they meet the necessary qualifications. Addi-

SANDERS -- (at request of the Department of Veterans' Services) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the New York city charter, in relation to opportunities for special veteran emerging business enterprises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs 1 and 3 of subdivision i of section 311 of the New York city charter, paragraph 1 as amended by chapter 110 of the laws of 2024 and paragraph 3 as amended by chapter 569 of the laws of 2022, are amended to read as follows: 1. agencies may make procurements of goods, services and construction for amounts not exceeding one million five hundred thousand dollars from businesses certified as minority or women-owned business enterprises pursuant to section thirteen hundred four of the charter AND FROM SPECIAL VETERAN EMERGING BUSINESS ENTERPRISES without a formal compet- itive process. 3. the rule or rules promulgated to implement paragraph one of this subdivision shall provide that the city shall, commencing on the first of October of the first full calendar year following the adoption of such rule or rules, submit an annual report to the governor and the state legislature of the total number and total dollar value of procure- ments of goods and services for amounts not exceeding the dollar amount threshold for making procurements without a formal competitive process as established by rule pursuant to paragraph one of this subdivision from: (i) businesses certified as minority or women-owned business enter- prises pursuant to section thirteen hundred four of the charter; (ii) SPECIAL VETERAN EMERGING BUSINESS ENTERPRISES; (III) all other businesses; and [(iii)] (IV) information about the number of businesses certified as minority or women-owned business enterprises pursuant to section thir- teen hundred four of this charter OR SPECIAL VETERAN EMERGING BUSINESS EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
