BILL NUMBER: S9882 SPONSOR: PARKER TITLE OF BILL: An act to amend the public officers law, in relation to disclosure of certain law enforcement agency records PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to ensure that civilian complaint review boards have full access to unredacted law enforcement disciplinary records and personnel records when investigating incidents involving police shootings or police misconduct. Specifically, the bill mandates that these records be provided in their complete, unredacted form to facilitate thorough and transparent investigations by civilian oversight bodies. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 89 of the public officers law by adding a new subdivision 2-d.

PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public officers law, in relation to disclosure of certain law enforcement agency records THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 89 of the public officers law is amended by adding a new subdivision 2-d to read as follows: 2-D. FOR RECORDS THAT CONSTITUTE LAW ENFORCEMENT DISCIPLINARY RECORDS, AS DEFINED IN SUBDIVISION SIX OF SECTION EIGHTY-SIX OF THIS ARTICLE, OR PERSONNEL RECORDS OF A MEMBER OF A LAW ENFORCEMENT AGENCY, AS DEFINED IN SUBDIVISION EIGHT OF SECTION EIGHTY-SIX OF THIS ARTICLE, A MEMBER OF A CIVILIAN COMPLAINT REVIEW BOARD THAT IS RESPONSIBLE FOR INVESTIGATING POLICE MISCONDUCT SHALL BE PROVIDED ALL SUCH LAW ENFORCEMENT DISCIPLI- NARY RECORDS OR PERSONNEL RECORDS REQUESTED IN THEIR UNREDACTED FORM IF SUCH RECORDS RELATE TO AN OFFICER WHO WAS INVOLVED IN A POLICE SHOOTING OR POLICE MISCONDUCT. § 2.
