BILL NUMBER: S9910 SPONSOR: GRIFFO TITLE OF BILL: An act to amend the environmental conservation law, in relation to regu- lations on the percentage of zero-emission vehicles in manufacturers' sales fleets PURPOSE: To delay implementation of New York State's adopted ACT regulation impacting medium and heavy-duty vehicles. SUMMARY OF PROVISIONS: 1. Section 1 amends Section 19-0306-b of the environmental conservation law to add subdivision 6 to prevent the establishment or enfo rcement of regulations or laws relating to the percentage of zero-emission vehicles in manufacturers' sales fleets of medium and heav y-duty vehicles until New York State infrastructure can meet such demand.

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the environmental conservation law, in relation to regu- lations on the percentage of zero-emission vehicles in manufacturers' sales fleets THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 19-0306-b of the environmental conservation law is amended by adding a new subdivision 6 to read as follows: 6. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE CONTRARY, NO REGULATION SHALL BE ESTABLISHED OR ENFORCED RELATING TO THE PERCENT- AGE OF ZERO-EMISSION VEHICLES IN MANUFACTURERS' SALES FLEETS OF MEDIUM- DUTY AND HEAVY-DUTY VEHICLES UNTIL THE AVAILABILITY OF SUFFICIENT CHARG- ING INFRASTRUCTURE, AND THE COST AND AVAILABILITY OF ZERO-EMISSION MEDIUM-DUTY AND HEAVY-DUTY VEHICLES MAKES THE SALE OF ZERO-EMISSION MEDIUM-DUTY AND HEAVY-DUTY VEHICLES MORE PRACTICABLE. § 2.
