BILL NUMBER: S9937 SPONSOR: CHU TITLE OF BILL: An act to amend the social services law, in relation to capping the monthly maximum payment for hotel rooms to house homeless persons PURPOSE: The purpose of this legislation is to set payment standards for contracting with hotels to provide rooms as shelter for home less popu- lations. SUMMARY OF PROVISIONS: Section one amends the social services law by adding a new section 43-a, which sets the payment rate for hotel rooms that will be used to provide shelter for homeless populations to 75% of the NYCHA Section 8 voucher payment standard for a studio apartment pro-rated daily. CHU -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to capping the monthly maximum payment for hotel rooms to house homeless persons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The social services law is amended by adding a new section 43-a to read as follows: § 43-A. CONTRACTING WITH HOTELS TO PROVIDE ROOMS AS SHELTER FOR HOME- LESS PERSONS; PAYMENT STANDARDS. 1. IN A CITY WITH A POPULATION OF MORE THAN ONE MILLION, NOTWITHSTANDING ANY PROVISION OF ANY FEDERAL LAW, RULE OR REGULATION TO THE CONTRARY, WHENEVER THE COMMISSIONER, SOCIAL SERVICES AGENCY, OR A CONTRACTED ENTITY SUBJECT TO THE PROVISIONS OF SECTION FORTY-THREE OF THIS ARTICLE ENTERS INTO CONTRACTS WITH HOTELS TO PROVIDE ROOMS AS SHELTER FOR HOMELESS PERSONS, THE DAILY MAXIMUM AMOUNT THE DEPARTMENT SHALL PAY UNDER A CONTRACT TO PROVIDE ROOMS FOR HOMELESS PERSONS SHALL BE EQUAL TO SEVENTY-FIVE PERCENT OF THE NEW YORK CITY HOUSING AUTHORITY SECTION 8 VOUCHER PAYMENT STANDARD FOR A STUDIO APART- MENT PRO-RATED DAILY. 2. IN A CITY WITH A POPULATION GREATER THAN ONE MILLION, NOTWITHSTAND- ING ANY PROVISION OF ANY FEDERAL LAW, RULE OR REGULATION TO THE CONTRA- RY, WHENEVER THE COMMISSIONER, SOCIAL SERVICES AGENCY, OR A CONTRACTED ENTITY SUBJECT TO THE PROVISIONS OF SECTION FORTY-THREE OF THIS ARTICLE ENTERS INTO CONTRACTS WITH HOTELS TO PROVIDE ROOMS AS SHELTER FOR MULTI- PLE HOMELESS INDIVIDUALS IN A CONGREGATE ROOM, THE DAILY MAXIMUM AMOUNT THE DEPARTMENT SHALL PAY UNDER A CONTRACT TO PROVIDE ROOMS FOR HOMELESS FAMILIES SHALL BE EQUAL TO SEVENTY-FIVE PERCENT OF THE NEW YORK CITY HOUSING AUTHORITY SECTION 8 VOUCHER PAYMENT STANDARD FOR AN APARTMENT OF APPROPRIATE HOUSING OCCUPANCY PRO-RATED DAILY. 3. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO HOTELS CONTRACTED TO PROVIDE ROOMS FOR HOMELESS FAMILIES SOUTH OF NINETY-SIXTH STREET IN NEW YORK COUNTY, COMMUNITY BOARDS ONE AND TWO LOCATED IN KINGS COUNTY AND COMMUNITY BOARDS ONE AND TWO LOCATED IN QUEENS COUNTY, OR DURING A DECLARED NATIONAL, STATE, OR LOCAL PUBLIC HEALTH EMERGENCY. § 2.
