 AN  ACT  to  amend the insurance law and the vehicle and traffic law, in
   relation to electronic delivery of notices
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subsection  (b)  of section 3458 of the insurance law, as
 amended by chapter 161 of the laws  of  2022,  is  amended  to  read  as
 follows:
   (b) Subject to the requirements of this section, any notice to a party
 or  any  other  document  required  under this chapter, PARAGRAPH (C) OF
 SUBDIVISION ONE OF SECTION THREE HUNDRED THIRTEEN  OF  THE  VEHICLE  AND
 TRAFFIC  LAW  in a property/casualty insurance transaction or that is to
 serve as evidence of property/casualty insurance coverage may be  deliv-
 ered by electronic means so long as it meets the requirements of article
 three  of  the  state  technology  law. Where this chapter requires that
 notice be mailed or delivered to an address shown  in  the  policy,  the
 notice may be delivered by electronic means to an electronic address not
 specified in the policy.
   §  2.  Subdivision  1 of section 313 of the vehicle and traffic law is
 amended by adding a new paragraph (c) to read as follows:
   (C) AN ELECTRONIC NOTICE THAT COMPLIES  WITH  SECTION  THREE  THOUSAND
 FOUR  HUNDRED  FIFTY-EIGHT  OF THE INSURANCE LAW SHALL BE SUFFICIENT FOR
 THE PURPOSES OF THIS SECTION.
   § 3. This act shall take effect immediately.
