SIMON, GONZALEZ-ROJAS -- read once and referred to the Committee on Governmental Operations AN ACT to amend the public officers law, in relation to quorum require- ments for meetings conducted remotely THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 103-a of the public officers law is amended by adding a new subdivision 2-a to read as follows: 2-A. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY MEMBER WHO HAS A DISABILITY AS DEFINED IN SECTION TWO HUNDRED NINETY-TWO OF THE EXECUTIVE LAW THAT RENDERS SUCH MEMBER UNABLE TO BE PHYSICALLY PRESENT AT ANY MEETING LOCATION MAY BE CONSIDERED PRESENT FOR PURPOSES OF FULFILLING THE QUORUM REQUIREMENT FOR THE PUBLIC BODY AT MEETINGS CONDUCTED THROUGH VIDEOCONFERENCING, PROVIDED THE APPLICABLE CRITERIA IN SUBDIVISION TWO OF THIS SECTION ARE OTHERWISE MET. § 2. This act shall take effect immediately; provided that the amend- ments to section 103-a of the public officers law made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith.
