   once and referred to the Committee on Codes
 
 AN ACT to amend the penal law, in relation to establishing the crime  of
   criminal  sale  of  a controlled substance resulting in death, a class
   A-1 felony
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The penal law is amended by adding a new section 125.30 to
 read as follows:
 § 125.30 CRIMINAL SALE OF A CONTROLLED SUBSTANCE RESULTING IN DEATH.
   A PERSON IS GUILTY OF CRIMINAL SALE OF A CONTROLLED SUBSTANCE  RESULT-
 ING  IN  DEATH WHEN SUCH PERSON, IN VIOLATION OF ARTICLE THIRTY-THREE OF
 THE PUBLIC HEALTH LAW, SELLS, EXCHANGES, GIVES, DISPOSES OF OR  SUPPLIES
 TO  THE  VICTIM A CONTROLLED SUBSTANCE LISTED IN SCHEDULE I, II, III, IV
 OR V OF SECTION THIRTY-THREE HUNDRED SIX OF THE PUBLIC  HEALTH  LAW  AND
 THE USE OF SUCH CONTROLLED SUBSTANCE CAUSES THE DEATH OF THE VICTIM.
   CRIMINAL  SALE OF A CONTROLLED SUBSTANCE RESULTING IN DEATH IS A CLASS
 A-1 FELONY.
   § 2. This act shall take effect on the thirtieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such effective date.
