 AN ACT to amend the labor law, in relation to granting public access  to
   employer lactation rooms
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 206-c of the labor law is amended by adding  a  new
 subdivision 5 to read as follows:
   5.  A  WORKPLACE WHICH HAS DESIGNATED A ROOM OR OTHER LOCATION FOR USE
 BY EMPLOYEES TO EXPRESS BREAST MILK PURSUANT TO SUBDIVISION TWO OF  THIS
 SECTION  SHALL  MAKE SUCH ROOM OR OTHER LOCATION AVAILABLE TO MEMBERS OF
 THE PUBLIC TO BREASTFEED OR EXPRESS BREAST MILK UPON REQUEST IF:
   (A) THERE IS NO COVERED PUBLIC BUILDING CONTAINING  A  LACTATION  ROOM
 PURSUANT TO SECTION ONE HUNDRED FORTY-FOUR OF THE PUBLIC BUILDINGS WITH-
 IN A ONE-HALF MILE RADIUS; AND
   (B) SUCH ROOM OR OTHER LOCATION IS NOT CURRENTLY IN USE BY AN EMPLOYEE
 OR LIKELY TO BE IN USE BY AN EMPLOYEE WITHIN THE NEXT HOUR; AND
   (C)  THE  REQUEST IS MADE AT A WORKPLACE THAT IS OPEN TO THE PUBLIC AT
 THE TIME OF THE REQUEST AND THE REQUEST IS MADE AT LEAST ONE HOUR BEFORE
 SUCH WORKPLACE'S CLOSING TIME; AND
   (D) SUCH ROOM OR LOCATION IS NOT IN USE AT  THE  TIME  FOR  ANY  OTHER
 PURPOSE OR FUNCTION PURSUANT TO PARAGRAPH (B) OF SUBDIVISION TWO OF THIS
 SECTION; AND
   (E)  COMPLYING  WITH  SUCH  REQUEST  WILL NOT IMPOSE UNDUE HARDSHIP OR
 SIGNIFICANT RISK TO THE WELLBEING OF THE EMPLOYER, THE EMPLOYEES, OR THE
 NORMAL OPERATIONS OF BUSINESS.
   § 2. This act shall take effect immediately.
