 AN ACT to amend the state finance law, in  relation  to  establishing  a
   water  and  waste  water  treatment system capital fund; and making an
   appropriation therefor
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  state finance law is amended by adding a new section
 97-bbbbb to read as follows:
   § 97-BBBBB. WATER AND WASTE WATER TREATMENT SYSTEM CAPITAL FUND.    1.
 THERE  IS  HEREBY  ESTABLISHED  IN  THE JOINT CUSTODY OF THE STATE COMP-
 TROLLER AND THE COMMISSIONER OF TAXATION AND FINANCE A  SPECIAL  CAPITAL
 FUND  TO BE KNOWN AS THE "WATER AND WASTE WATER TREATMENT SYSTEM CAPITAL
 FUND", HEREINAFTER REFERRED TO AS "THE FUND".
   2.  THE FUND SHALL CONSIST OF ALL MONEYS COLLECTED THEREFOR OR CREDIT-
 ED OR TRANSFERRED THERETO FROM ANY OTHER FUND, ACCOUNT OR SOURCE.    ANY
 INTEREST RECEIVED BY THE COMPTROLLER ON MONEYS ON DEPOSIT IN THE TRANSIT
 ASSISTANCE  FOR CAPITAL INVESTMENTS FUND SHALL BE RETAINED IN AND BECOME
 A PART OF SUCH FUND.
   3. MONEYS IN THE FUND SHALL, FOLLOWING APPROPRIATION BY  THE  LEGISLA-
 TURE,  BE  UTILIZED  FOR CAPITAL PURPOSES, INCLUDING, BUT NOT LIMITED TO
 THE PLANNING  AND  DESIGN,  ACQUISITION,  CONSTRUCTION,  RECONSTRUCTION,
 REPLACEMENT,  IMPROVEMENT,  RECONDITIONING, REHABILITATION AND PRESERVA-
 TION OF WATER AND WASTE WATER TREATMENT SYSTEMS.
   4. MONEYS DEPOSITED INTO THE FUND SHALL BE AVAILABLE TO MUNICIPALITIES
 THROUGHOUT THE STATE THROUGH A GRANT PROGRAM ESTABLISHED  BY  THE  COMP-
 TROLLER, IN CONSULTATION WITH THE COMMISSIONER OF TAXATION AND FINANCE.
   5.  ALL  PAYMENTS  OF  MONEYS  FROM THE TRANSIT ASSISTANCE FOR CAPITAL
 INVESTMENTS FUND SHALL BE MADE ON THE AUDIT AND  WARRANT  OF  THE  COMP-
 TROLLER.
