 AN  ACT  to  amend the public health law, in relation to authorizing and
   establishing a training program for paramedics for the  administration
   of buprenorphine
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 3309 of the public health law is amended by  adding
 a new subdivision 10 to read as follows:
   10.  THE  COMMISSIONER SHALL DEVELOP A TRAINING PROGRAM AND ASSOCIATED
 TRAINING MATERIALS FOR PARAMEDICS PROVIDING EMERGENCY  MEDICAL  SERVICES
 ON  PROTOCOLS  FOR THE ADMINISTRATION OF BUPRENORPHINE UPON THE ADMINIS-
 TRATION OF NALOXONE. PARAMEDICS SHALL BE AUTHORIZED TO  CARRY  BUPRENOR-
 PHINE  FOR  ADMINISTRATION  PURSUANT  TO  SUCH  PROTOCOLS  IN CASES OF A
 SUSPECTED OVERDOSE. SUCH PROTOCOLS SHALL PERMIT  THE  ADMINISTRATION  OF
 BUPRENORPHINE UPON A PARAMEDIC RECEIVING:
   (A) AUTHORIZATION FROM THE PHYSICIAN SUPERVISING SUCH PARAMEDIC; AND
   (B)  INFORMED CONSENT FROM THE PERSON RECEIVING SUCH EMERGENCY MEDICAL
 SERVICES.
   § 2. The public health law is amended by adding a new section 3055  to
 read as follows:
   §  3055.  BUPRENORPHINE ADMINISTRATION. THE COMMISSIONER SHALL PROVIDE
 THE TRAINING PROGRAM RELATING TO  THE  ADMINISTRATION  OF  BUPRENORPHINE
 UPON  THE  ADMINISTRATION  OF  NALOXONE  PURSUANT  TO SUBDIVISION TEN OF
 SECTION THIRTY-THREE HUNDRED NINE OF  THIS  CHAPTER  TO  ALL  PARAMEDICS
 PROVIDING  EMERGENCY  MEDICAL SERVICES. UPON COMPLETION OF SUCH TRAINING
 PARAMEDICS SHALL BE AUTHORIZED TO CARRY BUPRENORPHINE FOR ADMINISTRATION
 IN CASES OF A SUSPECTED OVERDOSE PURSUANT TO THE ESTABLISHED PROTOCOLS.
   § 3. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.
