   NOUGH,  STERN,  BRABENEC,  SIMPSON,   DURSO,   DeSTEFANO,   TANNOUSIS,
   LEMONDES,  MAHER,  CUNNINGHAM,  SMITH -- read once and referred to the
   Committee on Corporations, Authorities and Commissions
 
 AN ACT to amend the public authorities law, in relation to  establishing
   a  no fare program for transportation on the Long Island Rail Road for
   individuals in active military service of the United States and active
   duty members of the New York national guard
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  1266 of the public authorities law is amended by
 adding a new subdivision 20 to read as follows:
   20. (A) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE AUTHORITY,  IN
 CONSULTATION  WITH THE LONG ISLAND RAIL ROAD, SHALL ESTABLISH AND IMPLE-
 MENT A NO FARE PROGRAM FOR TRANSPORTATION ON THE LONG ISLAND  RAIL  ROAD
 FOR  INDIVIDUALS  IN  ACTIVE  MILITARY  SERVICE OF THE UNITED STATES AND
 ACTIVE DUTY MEMBERS OF THE NEW YORK NATIONAL GUARD.
   (B) IN ORDER TO BE ELIGIBLE FOR SUCH NO FARE PROGRAM, AN INDIVIDUAL IN
 ACTIVE MILITARY SERVICE OF THE UNITED STATES OR AN ACTIVE DUTY MEMBER OF
 THE NEW YORK NATIONAL GUARD SHALL SHOW THEIR MILITARY-ISSUED OR NEW YORK
 NATIONAL GUARD-ISSUED IDENTIFICATION CARD.
   (C) FOR THE PURPOSES OF THIS SUBDIVISION, THE TERMS  "ACTIVE  MILITARY
 SERVICE  OF  THE  UNITED STATES", "NEW YORK NATIONAL GUARD", "MILITARY",
 AND "ACTIVE DUTY" SHALL HAVE THE SAME MEANINGS AS DEFINED BY SECTION ONE
 OF THE MILITARY LAW.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
