 AN ACT to amend the education law, in relation to establishing the first
   of April as basic educational data system (BEDS) day
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  The education law is amended by adding a new section 3615
 to read as follows:
   § 3615. BASIC EDUCATIONAL DATA SYSTEM (BEDS) DAY. 1. FOR  PURPOSES  OF
 THIS  SECTION,  "BEDS  DAY" SHALL MEAN THE ANNUAL REPORTING DEADLINE FOR
 THE BASIC EDUCATIONAL DATA SYSTEM PURSUANT TO TITLE  EIGHT  OF  THE  NEW
 YORK CODES, RULES, AND REGULATIONS.
   2.  BEGINNING IN THE TWO THOUSAND TWENTY-FIVE--TWO THOUSAND TWENTY-SIX
 SCHOOL YEAR AND FOR EACH SCHOOL YEAR THEREAFTER, BEDS DAY SHALL OCCUR ON
 THE FIRST OF APRIL OF EACH YEAR.
   3. FOR BEDS REPORTING PURPOSES, STUDENT POPULATION CALCULATIONS  SHALL
 BE  BASED ON THE NUMBER OF STUDENTS ENROLLED AT A SCHOOL ON BEDS DAY FOR
 A GIVEN SCHOOL YEAR AND WHO ARE CONTINUOUSLY ENROLLED AT SUCH SCHOOL FOR
 MORE THAN HALF OF SUCH SCHOOL YEAR.
   4. THE COMMISSIONER SHALL ADOPT, PROMULGATE, AMEND, OR  RESCIND  RULES
 AND  REGULATIONS  TO  EFFECTUATE  THE  PURPOSES  AND  PROVISIONS OF THIS
 SECTION.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such effective date.
