 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to  prohibiting the issuance of tickets to residential occu-
   pants for certain violations of the sanitation code

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivisions c and d of section 16-118.1 of the administra-
 tive  code of the city of New York are redesignated subdivisions d and e
 and a new subdivision c is added to read as follows:
   C. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION A  OF  THIS  SECTION,
 DURING THE HOURS OF 3:00 P.M. ON FRIDAY THROUGH 6:00 P.M. ON SUNDAY, THE
 DEPARTMENT  SHALL  NOT ISSUE A NOTICE OF VIOLATION, APPEARANCE TICKET OR
 SUMMONS TO ANY OWNER, LESSEE, TENANT OR OCCUPANT OF A RESIDENTIAL  PROP-
 ERTY,  NOR  TO  A  PERSON  IN  CHARGE  OF SUCH PREMISES, FOR A VIOLATION
 RESULTING FROM PLACING TRASH OR GARBAGE OUT FOR COLLECTION EARLIER  THAN
 ALLOWED UNDER THE CITY ROUTING SYSTEM DESIGNATED HOURS.
   § 2. This act shall take effect immediately.

 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to  prohibiting the issuance of tickets to residential occu-
   pants for certain violations of the sanitation code
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision c of section 16-120 of the administrative code
 of the city of New York is amended by adding a new paragraph 4  to  read
 as follows:
   4.  NOTWITHSTANDING  ANY  PROVISION OF THIS SUBDIVISION OR ANY RULE OF
 THE DEPARTMENT RELATING TO COLLECTION TO THE  CONTRARY,  THE  DEPARTMENT
 SHALL  NOT  ISSUE A NOTICE OF VIOLATION, APPEARANCE TICKET OR SUMMONS TO
 ANY OWNER, LESSEE, TENANT OR  OCCUPANT  OF  A  RESIDENTIAL  BUILDING  OR
 DWELLING,  NOR  TO  A  PERSON WHO MANAGES OR CONTROLS SUCH A BUILDING OR
 DWELLING, FOR A VIOLATION OF PARAGRAPH (2)  OF  SUBDIVISION  E  OF  THIS
 SECTION OCCURRING BETWEEN THE HOURS OF 3:00 P.M. ON FRIDAY AND 6:00 P.M.
 ON  SATURDAY  AS  A  RESULT OF PLACING REFUSE, SOLID WASTE OR RECYCLABLE
 MATERIAL OUT FOR COLLECTION EARLIER THAN ALLOWED UNDER THE RULES OF  THE
 DEPARTMENT  RELATING  TO  COLLECTION  BY  THE DEPARTMENT OR BY A PRIVATE
 CHARTER THAT IS REQUIRED TO BE LICENSED OR REGISTERED PURSUANT TO  CHAP-
 TER 1 OF TITLE 16-A OF THE CODE.
   § 2. This act shall take effect immediately.
