EICHENSTEIN -- read once and referred to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to prohibiting the issuance of tickets to residential occu- pants for certain violations of the sanitation code THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions c and d of section 16-118.1 of the administra- tive code of the city of New York are redesignated subdivisions d and e and a new subdivision c is added to read as follows: C. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION A OF THIS SECTION, DURING THE HOURS OF 3:00 P.M. ON FRIDAY THROUGH 6:00 P.M. ON SUNDAY, THE DEPARTMENT SHALL NOT ISSUE A NOTICE OF VIOLATION, APPEARANCE TICKET OR SUMMONS TO ANY OWNER, LESSEE, TENANT OR OCCUPANT OF A RESIDENTIAL PROP- ERTY, NOR TO A PERSON IN CHARGE OF SUCH PREMISES, FOR A VIOLATION RESULTING FROM PLACING TRASH OR GARBAGE OUT FOR COLLECTION EARLIER THAN ALLOWED UNDER THE CITY ROUTING SYSTEM DESIGNATED HOURS. § 2. EICHENSTEIN, YEGER -- read once and referred to the Committee on Cities -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the administrative code of the city of New York, in relation to prohibiting the issuance of tickets to residential occu- pants for certain violations of the sanitation code THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision c of section 16-120 of the administrative code of the city of New York is amended by adding a new paragraph 4 to read as follows: 4. NOTWITHSTANDING ANY PROVISION OF THIS SUBDIVISION OR ANY RULE OF THE DEPARTMENT RELATING TO COLLECTION TO THE CONTRARY, THE DEPARTMENT SHALL NOT ISSUE A NOTICE OF VIOLATION, APPEARANCE TICKET OR SUMMONS TO ANY OWNER, LESSEE, TENANT OR OCCUPANT OF A RESIDENTIAL BUILDING OR DWELLING, NOR TO A PERSON WHO MANAGES OR CONTROLS SUCH A BUILDING OR DWELLING, FOR A VIOLATION OF PARAGRAPH (2) OF SUBDIVISION E OF THIS SECTION OCCURRING BETWEEN THE HOURS OF 3:00 P.M. ON FRIDAY AND 6:00 P.M. ON SATURDAY AS A RESULT OF PLACING REFUSE, SOLID WASTE OR RECYCLABLE MATERIAL OUT FOR COLLECTION EARLIER THAN ALLOWED UNDER THE RULES OF THE DEPARTMENT RELATING TO COLLECTION BY THE DEPARTMENT OR BY A PRIVATE CHARTER THAT IS REQUIRED TO BE LICENSED OR REGISTERED PURSUANT TO CHAP- TER 1 OF TITLE 16-A OF THE CODE. § 2.
