 AN ACT to amend the labor law, in relation to requiring minimum wage for
   public employees
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subparagraphs (h), (i) and (m) of the opening paragraph  of
 subdivision 5 of section 651 of the labor law, as amended by chapter 391
 of the laws of 2024, are amended to read as follows:
   (h)  in or for such a religious, educational or charitable institution
 if such individual is a student, PROVIDED THAT THIS EXCEPTION SHALL  NOT
 APPLY  TO  A  PUBLIC EDUCATIONAL INSTITUTION; (i) in or for such a reli-
 gious, educational or charitable institution if the earning capacity  of
 such  individual  is impaired by age or by physical or mental deficiency
 or injury, PROVIDED THAT THIS EXCEPTION SHALL  NOT  APPLY  TO  A  PUBLIC
 EDUCATIONAL INSTITUTION;
   (m)  by [a] THE federal[, state or municipal] government [or political
 subdivision thereof];
   § 2. Subdivision 6 of section 651 of the  labor  law,  as  amended  by
 chapter 281 of the laws of 2002, is amended to read as follows:
   6.  "Employer"  includes  any  individual,  partnership,  association,
 corporation, limited liability company, business trust, legal  represen-
 tative,  STATE  OR  LOCAL  GOVERNMENT, or any organized group of persons
 acting as employer.
   § 3. This act shall take effect immediately.
