S T A T E O F N E W Y O R K ________________________________________________________________________ 3944 2025-2026 Regular Sessions I N A S S E M B L Y January 30, 2025 ___________ Introduced by M. of A. BORES -- read once and referred to the Committee on Labor AN ACT to amend the labor law, in relation to benefit protections for certain state employees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "benefit maintenance act". § 2. The labor law is amended by adding a new section 202-m to read as follows: § 202-M. BENEFITS PROTECTION; EMPLOYEE TRANSFER BY APPOINTMENT. A STATE EMPLOYEE WHO IS APPOINTED PURSUANT TO SECTION SEVEN OF THE PUBLIC OFFICERS LAW TO A DIFFERENT POSITION IN A STATE AGENCY IS ENTITLED TO: 1. RETAIN ALL ACCRUED SICK LEAVE CREDITS; AND 2. RETAIN OR USE ACCRUED VACATION LEAVE CREDITS. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
