 AN ACT to amend the labor law, in relation to  benefit  protections  for
   certain state employees
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. This act shall be known and may be cited  as  the  "benefit
 maintenance act".
   § 2. The labor law is amended by adding a new section 202-m to read as
 follows:
   §  202-M.  BENEFITS  PROTECTION;  EMPLOYEE  TRANSFER BY APPOINTMENT. A
 STATE EMPLOYEE WHO IS APPOINTED PURSUANT TO SECTION SEVEN OF THE  PUBLIC
 OFFICERS LAW TO A DIFFERENT POSITION IN A STATE AGENCY IS ENTITLED TO:
   1. RETAIN ALL ACCRUED SICK LEAVE CREDITS; AND
   2. RETAIN OR USE ACCRUED VACATION LEAVE CREDITS.
   § 3. This act shall take effect immediately.
