2025-A41 (ACTIVE) - Summary

Prohibits a court from granting, denying or deciding a petition for guardianship, custody or visitation solely on the allegation or basis that a parent or guardian is providing or facilitating the provision of gender affirming care to the subject child.

 AN ACT to amend the domestic relations law, in relation to the consider-
   ation of gender affirming care in custody matters

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  domestic  relations  law  is amended by adding a new
 section 75-n to read as follows:
   § 75-N. CONSIDERATION OF PROVIDING GENDER AFFIRMING CARE. 1. THE COURT
 MAY NOT GRANT, DENY OR DECIDE A PETITION FOR  GUARDIANSHIP,  CUSTODY  OR
 VISITATION  SOLELY  ON THE ALLEGATION OR BASIS THAT A PARENT OR GUARDIAN
 IS PROVIDING OR FACILITATING THE PROVISION OF GENDER AFFIRMING  CARE  TO
 THE SUBJECT CHILD.
   2. AS USED IN THIS SECTION, "GENDER AFFIRMING CARE" MEANS CARE FOR THE
 SUBJECT CHILD WHICH ENCOMPASSES A RANGE OF SOCIAL, PSYCHOLOGICAL, BEHAV-
 IORAL, AND MEDICAL INTERVENTIONS DESIGNED TO SUPPORT AND AFFIRM AN INDI-
 VIDUAL'S  GENDER  IDENTITY  WHEN  IT CONFLICTS WITH THE GENDER THEY WERE
 ASSIGNED AT BIRTH.
   § 2. This act shall take effect immediately.
