 AN  ACT to amend the executive law, in relation to prohibiting interfer-
   ence with the provision of medical assistance to incarcerated individ-
   uals
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The executive law is amended by adding a new section 837-y
 to read as follows:
   § 837-Y. INTERFERENCE WITH THE  PROVISION  OF  MEDICAL  ASSISTANCE  TO
 INCARCERATED INDIVIDUALS. 1. FOR THE PURPOSES OF THIS SECTION:
   (A)  "POLICE OFFICER" MEANS A PERSON DESIGNATED AS SUCH IN SUBDIVISION
 THIRTY-FOUR OF SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW.
   (B) "PEACE OFFICER" MEANS A PERSON LISTED IN SECTION 2.10 OF THE CRIM-
 INAL PROCEDURE LAW.
   2. NO POLICE OFFICER, PEACE OFFICER  OR  EMPLOYEE  OF  A  CORRECTIONAL
 FACILITY,  AS DEFINED IN SECTION TWO OF THE CORRECTION LAW, SHALL INTER-
 FERE WITH THE PROVISION OF MEDICAL ASSISTANCE TO AN  INCARCERATED  INDI-
 VIDUAL.
   3.  ANY  POLICE  OFFICER,  PEACE OFFICER OR EMPLOYEE OF A CORRECTIONAL
 FACILITY WHO INTERFERES WITH THE PROVISION OF MEDICAL ASSISTANCE  TO  AN
 INCARCERATED  INDIVIDUAL IN VIOLATION OF THIS SECTION SHALL BE GUILTY OF
 A CLASS E FELONY.
   § 2. This act shall take effect immediately.
