S T A T E O F N E W Y O R K ________________________________________________________________________ 5467 2025-2026 Regular Sessions I N A S S E M B L Y February 14, 2025 ___________ Introduced by M. of A. E. BROWN -- read once and referred to the Commit- tee on Codes AN ACT to amend the executive law, in relation to granting federal immi- gration enforcement powers to local law enforcement agencies in New York state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "New York state immigration enforcement act of 2025". § 2. Legislative findings. The legislature finds that: 1. Criminal activity committed by illegal immigrants, especially those with a history of violent or gang-related offenses, poses a significant threat to public safety in New York state communities. 2. Local law enforcement agencies have an essential role in ensuring the safety of all residents, and their capacity to cooperate with feder- al authorities to enforce immigration law strengthens public safety. 3. Federal authorities, specifically United States Immigration and Customs Enforcement ("ICE"), offer an opportunity to local law enforce- ment to assist in the identification, arrest, and deportation of crimi- nal illegal immigrants. 4. Nassau County has recently entered into an agreement with ICE under the 287(g) program, and this approach has proven effective in addressing the safety concerns associated with illegal immigration and crime. 5. It is in the best interest of New York state to extend this model statewide to enhance local law enforcement's ability to combat criminal activity by individuals residing unlawfully in the United States. § 3. The executive law is amended by adding a new section 837-y to read as follows: § 837-Y. COOPERATION WITH FEDERAL IMMIGRATION ENFORCEMENT AGENCY. 1. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
