 AN ACT to amend the education law, in relation to creating an artificial
   intelligence working group in the department of education; and provid-
   ing for the repeal of such provisions upon expiration thereof

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Legislative findings.  The legislature finds and declares
 that there is an urgent need for  state  guidance  and  locally  adopted
 policies regarding the safe and effective use of artificial intelligence
 in  education  to  benefit  and protect pupils and educators.  It is the
 intent of the legislature to ensure that the use of artificial  intelli-
 gence  technology-enabled teaching and learning practices are in coordi-
 nation with, rather than a replacement of, educators.
   § 2. The education law is amended by adding a new section 115 to  read
 as follows:
    §  115. ARTIFICIAL INTELLIGENCE WORKING GROUP. 1. FOR THE PURPOSES OF
 THIS SECTION:
   (A) "ARTIFICIAL INTELLIGENCE SYSTEM"  OR  "AI  SYSTEM"  SHALL  MEAN  A
 MACHINE-BASED  SYSTEM THAT, FOR EXPLICIT OR IMPLICIT OBJECTIVES, INFERS,
 FROM THE INPUT IT RECEIVES, HOW TO GENERATE OUTPUTS SUCH AS PREDICTIONS,
 CONTENT, RECOMMENDATIONS, OR DECISIONS THAT CAN  INFLUENCE  PHYSICAL  OR
 VIRTUAL  ENVIRONMENTS.  DIFFERENT  AI  SYSTEMS  VARY  IN THEIR LEVELS OF
 AUTONOMY AND ADAPTIVENESS AFTER DEPLOYMENT.
   (B) "WORKING GROUP" MEANS THE ARTIFICIAL  INTELLIGENCE  WORKING  GROUP
 CREATED BY THIS SECTION.
   2.  THERE  IS  HEREBY CREATED IN THE DEPARTMENT AN ARTIFICIAL INTELLI-
 GENCE WORKING GROUP FOR THE PURPOSES OF:
   (A) DEVELOPING GUIDANCE ON THE SAFE AND EFFECTIVE  USE  OF  ARTIFICIAL
 INTELLIGENCE  IN  WAYS  THAT BENEFIT, AND DO NOT HARM, PUPILS AND EDUCA-
 TORS;
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
