 AN ACT to amend the public health law,  in  relation  to  requiring  the
   establishment  of  workplace  violence  prevention  plans  for certain
   health care facilities
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public health law is amended by adding a new section
 2832 to read as follows:
   § 2832. WORKPLACE VIOLENCE  PREVENTION  PLANS.  1.  BEGINNING  JANUARY
 FIRST, TWO THOUSAND TWENTY-SIX, EVERY FACILITY LICENSED UNDER THIS ARTI-
 CLE,  IN CONSULTATION WITH SUCH FACILITY'S AFFECTED EMPLOYEES, INCLUDING
 THE RECOGNIZED COLLECTIVE BARGAINING AGENT  OR  AGENTS,  IF  ANY,  SHALL
 ESTABLISH  A  WORKPLACE  VIOLENCE  PREVENTION  PLAN.  SUCH PLAN SHALL BE
 UPDATED ANNUALLY AND SHALL INCLUDE:
   (A) A FACILITY SAFETY AND SECURITY ASSESSMENT TO IDENTIFY AND EVALUATE
 RISKS INCLUDING TO THE  FACILITY'S  LAYOUT,  THE  IMPACT  OF  SUFFICIENT
 STAFFING,  THE  CRIME RATE IN THE SURROUNDING AREAS, AND THE ADEQUACY OF
 CURRENT TRAINING AND PROTECTIVE MEASURES;
   (B) POLICIES TO ADDRESS AND REDUCE RISKS IDENTIFIED IN THE  ASSESSMENT
 INCLUDING  TRAINING,  INCREASED  STAFFING  AND  SECURITY,  EQUIPMENT AND
 FACILITY MODIFICATIONS; AND
   (C) POLICIES ON THE REPORTING OF VIOLENT INCIDENTS INCLUDING  BUT  NOT
 LIMITED   TO  FACILITY  SECURITY,  FACILITY  ADMINISTRATION,  LOCAL  LAW
 ENFORCEMENT AND TO THE DEPARTMENT.
   2. EVERY FACILITY SHALL MAKE THE WORKPLACE  VIOLENCE  PREVENTION  PLAN
 AVAILABLE, UPON REQUEST, TO ITS EMPLOYEES AND TO THE DEPARTMENT.
   § 2. This act shall take effect immediately.
