 AN ACT to amend the vehicle and traffic law and the public officers law,
   in relation to owner liability for failure to stop at a stop  sign  or
   yield for a pedestrian

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The vehicle and traffic law is  amended  by  adding  a  new
 section 1174-b to read as follows:
   §  1174-B.  OWNER  LIABILITY FOR FAILURE OF OPERATOR TO STOP AT A STOP
 SIGN OR YIELD FOR A PEDESTRIAN AS REQUIRED BY LAW.  (A)  NOTWITHSTANDING
 ANY  OTHER  PROVISION  OF LAW, ANY MUNICIPALITY IS HEREBY AUTHORIZED AND
 EMPOWERED TO ADOPT AND AMEND A LOCAL LAW  OR  ORDINANCE  ESTABLISHING  A
 PROGRAM  IMPOSING MONETARY LIABILITY ON THE OWNER OF A VEHICLE FOR FAIL-
 URE OF AN OPERATOR THEREOF TO COMPLY WITH  SUBDIVISION  (A)  OF  SECTION
 ELEVEN HUNDRED SEVENTY-TWO, SECTION ELEVEN HUNDRED FORTY-TWO, OR SECTION
 ELEVEN  HUNDRED FIFTY-ONE OF THIS TITLE. SUCH PROGRAM SHALL EMPOWER SUCH
 MUNICIPALITY TO INSTALL AND OPERATE STOP SIGN  AND  PEDESTRIAN  CROSSING
 PHOTO  VIOLATION  MONITORING  SYSTEMS WHICH MAY BE STATIONARY OR MOBILE,
 AND WHICH MAY BE INSTALLED WITHIN THE BOUNDARIES OF SUCH MUNICIPALITY.
   (B) SUCH PROGRAM SHALL UTILIZE NECESSARY TECHNOLOGIES  TO  ENSURE,  TO
 THE   EXTENT  PRACTICABLE,  THAT  PHOTOGRAPHS  PRODUCED  BY  SUCH  PHOTO
 VIOLATION MONITORING SYSTEMS SHALL NOT INCLUDE IMAGES THAT IDENTIFY  THE
 DRIVER, THE PASSENGERS, OR THE CONTENTS OF THE VEHICLE. PROVIDED, HOWEV-
 ER, THAT NO NOTICE OF LIABILITY ISSUED PURSUANT TO THIS SECTION SHALL BE
 DISMISSED SOLELY BECAUSE A PHOTOGRAPH OR PHOTOGRAPHS ALLOW FOR THE IDEN-
 TIFICATION  OF  THE  DRIVER,  PASSENGERS,  OR THE CONTENTS OF A VEHICLE,
 PROVIDED THAT SUCH MUNICIPALITY HAS MADE A REASONABLE EFFORT  TO  COMPLY
 WITH THE PROVISIONS OF THIS PARAGRAPH.
   (C)  IN  ANY  SUCH MUNICIPALITY WHICH HAS ADOPTED A LOCAL LAW OR ORDI-
 NANCE PURSUANT TO SUBDIVISION (A) OF THIS SECTION, THE OWNER OF A  VEHI-
