 AN ACT to amend the public service law, in relation to electric  vehicle
   charging station fee transparency
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public service law is amended by adding a  new  section
 66-x to read as follows:
   §  66-X. ELECTRIC VEHICLE CHARGING STATION FEE TRANSPARENCY. 1. "ELEC-
 TRIC VEHICLE CHARGING STATION" SHALL HAVE THE SAME MEANING AS IN  SUBDI-
 VISION  ONE OF SECTION THREE HUNDRED THIRTY-NINE-LL OF THE REAL PROPERTY
 LAW.
   2. THE DEPARTMENT IS HEREBY AUTHORIZED AND DIRECTED TO, NO LATER  THAN
 JUNE  FIRST,  TWO THOUSAND TWENTY-SIX, PROMULGATE RULES AND REGULATIONS:
 (A) ESTABLISHING FEE TRANSPARENCY STANDARDS FOR ELECTRIC VEHICLE  CHARG-
 ING STATIONS, PROVIDED SUCH STANDARDS SHALL:
   (I)  REQUIRE  ELECTRIC  VEHICLE  CHARGING STATIONS TO CLEARLY POST AND
 UPDATE THE TOTAL PRICE FOR THE USE  OF  THE  ELECTRIC  VEHICLE  CHARGING
 STATION AT THE POINT OF SALE;
   (II)  PROHIBIT ELECTRIC VEHICLE CHARGING STATIONS FROM REQUIRING USERS
 TO PAY A SUBSCRIPTION FEE IN ORDER TO USE SUCH STATION; AND
   (III) PROHIBIT  REQUIRING  PAYMENT  VIA  MOBILE  DEVICE  AS  THE  ONLY
 ACCEPTED FORM OF PAYMENT; AND
   (B)  DEFINING  "SIGNIFICANT  UPGRADE",  WHICH  SHALL  BE THE BASIS FOR
 DETERMINING  WHAT  CHANGES  TO  ELECTRIC   VEHICLE   CHARGING   STATIONS
 CONSTRUCTED PRIOR TO JANUARY FIRST, TWO THOUSAND TWENTY-SEVEN, INCLUDING
 BUT  NOT  LIMITED  TO,  INCREASING  THE CAPACITY OF THE ELECTRIC VEHICLE
 CHARGING STATION OR SUBSTANTIALLY UPDATING THE ELECTRIC VEHICLE CHARGING
 STATION'S USER INTERFACE OR PAYMENT  SYSTEM,  WOULD  TRIGGER  COMPLIANCE
 WITH THE PROVISIONS OF THIS SECTION.
