S T A T E O F N E W Y O R K ________________________________________________________________________ 7661 2025-2026 Regular Sessions I N A S S E M B L Y April 4, 2025 ___________ Introduced by M. of A. STERN -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to retention of court records pertaining to violent felonies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The criminal procedure law is amended by adding a new section 180.86 to read as follows: § 180.86 RETENTION OF COURT RECORDS PERTAINING TO VIOLENT FELONIES. THE CHIEF ADMINISTRATOR OF THE COURTS SHALL PROMULGATE SCHEDULES FOR THE RETENTION AND DISPOSITION OF COURT RECORDS PERTAINING TO PERSONS CONVICTED OF VIOLENT FELONIES. THE CHIEF ADMINISTRATOR SHALL DIRECT THAT ALL SUCH RECORDS PERTAINING TO VIOLENT FELONY CONVICTIONS BE EXEMPT FROM DISPOSITION OR EXPUNGEMENT AND SHALL BE RETAINED INDEFINITELY. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04141-01-5
