 AN ACT to amend the correction law, in relation to requiring  the  state
   to  pay  for the delivery of the body of a deceased incarcerated indi-
   vidual to their next of kin
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The correction law is amended by adding a new section 624-a
 to read as follows:
   §  624-A.  DEATH  OF  INCARCERATED  INDIVIDUAL;  DISPOSITION  OF BODY.
 NOTWITHSTANDING ANY PROVISION OF LAW, RULE OR REGULATION TO THE  CONTRA-
 RY,  WHEN  AN INCARCERATED INDIVIDUAL DIES IN THE CUSTODY OF THE DEPART-
 MENT, THE DEPARTMENT SHALL DELIVER THE BODY OF SUCH  INCARCERATED  INDI-
 VIDUAL  TO THEIR NEXT OF KIN WHO IS A RELATIVE BY BLOOD OR MARRIAGE OR A
 BONA FIDE FRIEND. THE EXPENSE OF SUCH DELIVERY SHALL  BE  BORNE  BY  THE
 STATE.
   § 2. This act shall take effect immediately.
