 AN  ACT to amend the vehicle and traffic law, in relation to authorizing
   certain persons to use an ATV to enter and exit certain  lands  during
   ice fishing season
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 2403 of the vehicle and traffic law is  amended  by
 adding a new subdivision 2-a to read as follows:
   2-A. PUBLIC LANDS PERMITTING ICE FISHING.  DURING TIMES WHEN ICE FISH-
 ING  IS PERMITTED AND ONLY ON LANDS WHERE SNOWMOBILE USE IS PERMITTED BY
 THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION, INCLUDING WILDLIFE MANAGE-
 MENT AREAS, STATE FORESTS, FOREST PRESERVES, AND STATE PARKS,  A  PERSON
 MAY  OPERATE  AN  ATV  TO  ENTER AND EXIT SUCH LANDS WHEN SUCH PERSON IS
 SIXTY-FIVE YEARS OF AGE OR OLDER OR HAS A MOBILITY IMPAIRMENT THAT WOULD
 OTHERWISE PREVENT SUCH PERSON FROM ICE FISHING ACCESS WITHOUT THE USE OF
 SUCH ATV, AS DETERMINED BY A PHYSICIAN. SUCH PERSONS MAY UTILIZE AN  ATV
 AS  THE OPERATOR OR PASSENGER AND SHALL RESTRICT SUCH USAGE TO TRAVELING
 TO AND FROM ICE FISHING LOCATIONS.
   § 2. This act shall take effect immediately.
