2025-A7989 (ACTIVE) - Summary

Provides that where a board of cooperative educational services has made a provisional appointment to a position and no civil service examination for such position has been conducted within nine months of such appointment, the provisional appointment shall not expire and shall be considered permanent.

 AN ACT to amend the civil service law,  in  relation  to  providing  for
   board  of  cooperative  educational  services  employees who have been
   provisionally appointed to a position for at least nine months without
   an exam being  offered  for  such  position  to  receive  a  permanent
   appointment in such position
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 65 of the civil service law is amended by adding  a
 new subdivision 5 to read as follows:
   5.  PROVISIONAL  APPOINTMENTS WITHIN BOARDS OF COOPERATIVE EDUCATIONAL
 SERVICES. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF THIS CHAPTER  OR
 ANY  OTHER  LAW  OR  RULE  TO THE CONTRARY, WHERE A BOARD OF COOPERATIVE
 EDUCATIONAL SERVICES HAS MADE A PROVISIONAL APPOINTMENT  TO  A  POSITION
 AND  NO  CIVIL  SERVICE EXAMINATION FOR SUCH POSITION HAS BEEN CONDUCTED
 WITHIN NINE MONTHS OF  SUCH  APPOINTMENT,  THE  PROVISIONAL  APPOINTMENT
 SHALL  NOT  EXPIRE UNDER SUBDIVISION TWO OF THIS SECTION AND INSTEAD THE
 PROVISIONAL  APPOINTEE  SHALL  BE  CONSIDERED  TO  HAVE  BEEN  APPOINTED
 CONSISTENT WITH SECTION SIXTY-ONE OF THIS TITLE.
   § 2. This act shall take effect immediately.
