TITLE OF BILL:

An act to amend the state finance law, the public buildings law, and the
parks, recreation and historic preservation law, in relation to requir-
ing events held by the state or on state property which include alcohol
to include alcohol produced within the state

 
PURPOSE:

Requires events held by the state or on state property which include
alcohol to include alcohol produced within the state.

 
SUMMARY OF PROVISIONS:

Section 1 amends the state finance law to require state agencies, the
legislature, and the judiciary that serve alcohol to serve alcohol
produced in New York State, with at least one made by a farm meadery,
brewery, cidery, or winery.

Section 2 amends the public buildings law to require all events at state
owned or leased buildings or grounds adjacent to state owned buildings
that serve alcohol must serve alcohol made within the state with at
least one option made by a farm meadery, brewery, cidery, or winery.

Section 3 amends the parks, recreation and historic preservation law to
require any event at a state operated or maintained historic site, park,
parkway or recreational facility where alcohol is served must include
alcohol with at least one option made by a farm meadery, brewery,
cidery, or winery.

Section 4 includes the effective date, which is one year after the bill
becomes law.

 
JUSTIFICATION:

From Finger Lakes wineries to microbreweries, New York State is home to
numerous excellent breweries, wineries, and distilleries that deserve to
be showcased by the state. Yet, it is a rare occurrence to find a New
York State produced alcoholic beverage at state facilities or at state
events. This legislation would require state agencies and state owned or
leased buildings that serve alcohol to include choices made right here
in the Empire State. It would also require state sponsored events to
serve alcohol made in New York, which includes events that occur at
state parks or state historic sites.

Additionally, this bill requires at least one option to be from a farm
meadery, brewery, cidery or winery to ensure that small businesses and
agriculture are included as well.

 AN ACT to amend the state finance law, the public buildings law, and the
   parks,  recreation  and  historic  preservation  law,  in  relation to
   requiring events held by the state or on state property which  include
   alcohol to include alcohol produced within the state
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The state finance law is amended by adding  a  new  section
 163-e to read as follows:
   §  163-E.  STATE ALCOHOL PRODUCTS. EACH STATE AGENCY, THE LEGISLATURE,
 AND THE JUDICIARY SHALL INCLUDE IN ANY SET OF PROCUREMENTS FOR AN  EVENT
 WHERE  ALCOHOLIC  BEVERAGES,  INCLUDING, BUT NOT LIMITED TO, BEER, WINE,
 AND SPIRITS, WILL BE SERVED A PROCUREMENT FOR ALCOHOLIC  BEVERAGES  MADE
 WITHIN THE STATE TO BE SERVED AT SUCH EVENT.
   §  2.  The public buildings law is amended by adding a new section 148
 to read as follows:
   § 148. STATE ALCOHOL PRODUCTS. THE COMMISSIONER  OF  GENERAL  SERVICES
 SHALL  REQUIRE  THAT  ANY  EVENT WHICH OCCURS IN A STATE OWNED OR LEASED
 BUILDING OR THE GROUNDS AND PREMISES ADJACENT OR APPURTENANT THERETO  OR
 CONNECTED  THERETO  OR  CONNECTED THEREWITH BELONGING TO THE STATE WHERE
 ALCOHOLIC BEVERAGES, INCLUDING, BUT NOT  LIMITED  TO,  BEER,  WINE,  AND
 SPIRITS, ARE SERVED ALSO SERVE ALCOHOLIC BEVERAGES MADE WITHIN THE STATE
 AT SUCH EVENT.
   § 3. The parks, recreation and historic preservation law is amended by
 adding a new section 3.27 to read as follows:
   § 3.27 STATE ALCOHOL PRODUCTS. THE COMMISSIONER SHALL REQUIRE THAT ANY
 EVENT  WHICH  OCCURS  IN  A  STATE OPERATED OR MAINTAINED HISTORIC SITE,
 PARK,  PARKWAY  OR  RECREATIONAL  FACILITY  WHERE  ALCOHOLIC  BEVERAGES,
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 INCLUDING,  BUT NOT LIMITED TO, BEER, WINE, AND SPIRITS, ARE SERVED ALSO
 SERVE ALCOHOLIC BEVERAGES MADE WITHIN THE STATE AT SUCH EVENT.
   §  4. This act shall take effect one year after it shall have become a
 law.
