TITLE OF BILL:

An act to authorize Jonathan Montalvo to be placed on the eligible list
for employment as a full-time university police officer for the state
university of New York police

 
PURPOSE:

This bill would grant a waiver to Jonathan Montalvo to take be placed on
the eligible list for appointment as a full-time university police offi-
cer for the state university of New York police, contingent on his score
on a civil service exam for such position.

 
SUMMARY OF PROVISIONS:

Section 1 allows for Jonathan Montalvo to be placed on the eligible list
for appointment for the position of full-time university police officer
for the state university of New York police, contingent on his score on
a civil service exam for such position.

Section 2 stipulates that Jonathan Montalvo shall be subject to the
merit and fitness provisions of the civil service law.

Section 3 sets the effective date.

 
JUSTIFICTION:

Jonathan Montalvo took the civil service exam for the position of full-
time university police officer for the state university of New York
police in 2020 and was placed on the eligible list. The list was expired
in 2023, earlier than the expected date of 2024, making Mr. Montalvo no
longer eligible for appointment to the position due to his age. This
legislation would provide Jonathan Montalvo with an age-based waiver to
the SUNY Police Officer eligibility requirements, providing him the
opportunity to be placed on the eligible list for appointment for the
position of full-time university police officer for SUNY Police contin-
gent on his score on a civil service exam.

 Introduced  by  Sen. JACKSON -- read twice and ordered printed, and when
   printed to be committed to the Committee on Civil Service and Pensions
 
 AN ACT to authorize Jonathan Montalvo to be placed on the eligible  list
   for  employment as a full-time university police officer for the state
   university of New York police

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Notwithstanding the provisions of section 58 of the civil
 service law, including the  age  requirements  under  paragraph  (a)  of
 subdivision  1  of  such  section,  or any other provision of law to the
 contrary, Jonathan Montalvo, shall be  eligible  to  be  placed  on  the
 eligible  list  for appointment as a full-time university police officer
 with the state university of New York police, contingent upon his  score
 on a civil service examination for such position.
   §  2.  Jonathan  Montalvo  shall otherwise be subject to the merit and
 fitness provisions of the civil  service  law  applicable  to  full-time
 university police officers.
   § 3. This act shall take effect immediately.
