 Introduced  by  Sens.  SERRANO,  BAILEY,  HOYLMAN-SIGAL, KRUEGER -- read
   twice and ordered printed, and when printed to  be  committed  to  the
   Committee on Environmental Conservation
 
 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   authorizing the attorney general to enforce the provisions of such law
   and the rules and regulations adopted pursuant thereto
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 1-0305 to read as follows:
 § 1-0305. POWERS OF THE ATTORNEY GENERAL.
   NOTWITHSTANDING ANY PROVISION OF THIS CHAPTER  TO  THE  CONTRARY,  THE
 ATTORNEY  GENERAL, UPON THE ATTORNEY GENERAL'S OWN INITIATIVE, IS HEREBY
 AUTHORIZED TO, IN THE NAME OF THE PEOPLE  OF  THE  STATE  OF  NEW  YORK,
 ENFORCE  THE  PROVISIONS  OF  THIS CHAPTER AND THE RULES AND REGULATIONS
 PROMULGATED PURSUANT THERETO BY COMMENCING A  SPECIAL  PROCEEDING  IN  A
 COURT HAVING JURISDICTION.
   § 2. This act shall take effect immediately.
