BILL NUMBER: S1509 SPONSOR: LIU TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring in person hearings for traffic infractions PURPOSE OR GENERAL IDEA OF BILL: To ensure that any and all hearings conducted in any Traffic Violation's Bureau in New York City be held in-person, in the physical location of a hearing office, with all necessary parties and witnesses present within the same room, but for the informed consent of the accused or their counsel. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends the vehicle and traffic law by creating a new subdivi- sion that enshrines the right of any person that has received a moving violation summons in the five boroughs of New York City to appear in-person in a physical hearing office with all necessary parties pres-

LIU, FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring in person hearings for traffic infractions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 227 of the vehicle and traffic law is amended by adding a new subdivision 7 to read as follows: 7. EVERY HEARING FOR THE ADJUDICATION OF A TRAFFIC INFRACTION SHALL BE HELD IN PERSON, WITH ALL PARTIES AND WITNESSES PHYSICALLY PRESENT AT THE STATED TIME AND PLACE OF THE HEARING, PROVIDED THAT VIRTUAL ATTENDANCE AT SUCH HEARING SHALL BE PERMISSIBLE UPON THE REQUEST OR CONSENT OF THE MOTORIST OR THE MOTORIST'S COUNSEL. ON OR BEFORE THE DATE OF A HEARING, A MOTORIST, OR THE MOTORIST'S COUNSEL, SHALL BE PERMITTED TO APPEAR IN PERSON BEFORE A HEARING OFFICER FOR THE PURPOSE OF REQUESTING AN ADJOURNMENT. IF UNABLE TO APPEAR, THE MOTORIST, OR THE MOTORIST'S COUN- SEL, SHALL BE PERMITTED TO REQUEST AN ADJOURNMENT IN PERSON AFTER A HEARING HAS OCCURRED UPON GOOD CAUSE SHOWN. § 2.
