2025-S152 (ACTIVE) - Summary

Provides that when a person is convicted of two or more felony counts and at least one of which is an offense defined in article 265 of the penal law involving the possession or use of an illegal firearm, rifle or shotgun, the sentences must run consecutively.

 Introduced  by  Sens.  PALUMBO,  BORRELLO,  OBERACKER  -- read twice and
   ordered printed, and when printed to be committed to the Committee  on

 AN  ACT  to  amend  the  penal  law, in relation to consecutive terms of
   imprisonment

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section  70.25 of the penal law is amended by adding a new
 subdivision 2-h to read as follows:
   2-H. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY,  WHEN
 A  PERSON  IS CONVICTED OF TWO OR MORE FELONY COUNTS AND AT LEAST ONE OF
 WHICH IS AN OFFENSE DEFINED IN ARTICLE TWO HUNDRED  SIXTY-FIVE  OF  THIS
 CHAPTER  INVOLVING THE POSSESSION OR USE OF AN ILLEGAL FIREARM, RIFLE OR
 SHOTGUN, THE SENTENCES MUST RUN CONSECUTIVELY.
   § 2. This act shall take effect immediately.
