TITLE OF BILL:

An act to amend the transportation law, in relation to requiring the
department of transportation to develop an updated New York state bicy-
cle and pedestrian plan

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to establish regular updates to the state's
plan for bicycle and pedestrian transportation infrastructure.

 
SUMMARY OF PROVISIONS:

Section 1 requires the department to update its plan and to continue to
do so every five years.

Section 2 sets the effective date.

JUSTIFICATION:

The New York State Bicycle and Pedestrian Plan/Policy, last revised in
2010 with its roots in 1997, is essential for addressing the needs of
non-motorized road users. However, given the changing landscape of
transportation and the increasing focus on sustainable alternatives,
regular updates to this plan are necessary. This justification primarily
revolves around strengthening safety measures and fostering a culture
that encourages the adoption of alternative transportation modes.

The transportation landscape has evolved since the last plan update in
2010. The emergence of new mobility options like e-bikes and shared
services requires an adaptable framework to integrate these modes safe-
ly. Technological advancements, such as smart intersections and improved
safety features, call for a reassessment of the plan to leverage these
innovations for enhanced safety.

Furthermore, with a renewed focus on economic and environmental sustain-
ability, updating the plan can align transportation policies with broad-
er goals. Encouraging alternative transportation not only reduces
congestion and emissions but also contributes to the overall health and
wellbeing of communities. Public participation and inclusivity are
crucial components of the update, ensuring that diverse stakeholders
have a voice in the planning process. By enacting a law mandating regu-
lar updates, the state can proactively address these considerations,
keeping the plan relevant, effective, and reflective of the evolving
needs of New York's residents.

 AN ACT to amend the transportation law, in  relation  to  requiring  the
   department  of  transportation  to  develop  an updated New York state
   bicycle and pedestrian plan

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 14 of the transportation law is amended by adding a
 new subdivision 37 to read as follows:
   37.  (A)  TO  DEVELOP AN UPDATED NEW YORK STATE BICYCLE AND PEDESTRIAN
 PLAN, ADAPTED FROM THE DEPARTMENT'S NINETEEN  HUNDRED  NINETY-SEVEN  NEW
 YORK  STATE BICYCLE AND PEDESTRIAN PLAN FOR ACTION ON INFRASTRUCTURE AND
 PROGRAMMING, AND IDENTIFY STEPS FOR THE IMPLEMENTATION, INTEGRATION, AND
 EVALUATION OF SUCH PLAN.
   (B) SUCH UPDATED PLAN SHALL ADDRESS CHANGING CIRCUMSTANCES IN  BICYCLE
 AND  PEDESTRIAN  POLICY,  INCLUDING  BUT  NOT LIMITED TO BICYCLE SHARING
 PROGRAMS, THE STATE'S COMPLETE  STREETS  PROGRAMS  PURSUANT  TO  SECTION
 THREE  HUNDRED  THIRTY-ONE OF THE HIGHWAY LAW, THE EXPANSION OF ELECTRIC
 SCOOTERS AND BICYCLES WITH ELECTRIC ASSIST AS DEFINED  BY  SECTIONS  ONE
 HUNDRED FOURTEEN-E AND ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW,
 AND  RECOMMENDATIONS FOR UPDATES TO STATE LAWS AND POLICIES TO ENCOURAGE
 BICYCLE AND PEDESTRIAN SAFETY.
   (C) SUCH UPDATED PLAN SHALL BE DEVELOPED NO LATER THAN DECEMBER  THIR-
 TY-FIRST,  TWO THOUSAND TWENTY-SIX AND SHALL BE RE-EVALUATED AND UPDATED
 PURSUANT TO THE REQUIREMENTS OF THIS SUBDIVISION EVERY FIVE YEARS THERE-
 AFTER. SUCH PLAN SHALL BE MADE PUBLICLY AVAILABLE UPON ITS DEVELOPMENT.
   § 2. This act shall take effect immediately.
