BILL NUMBER: S1837 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the public service law, in relation to requiring a study on the height of overhead utility lines and communication lines as such relate to the height of agricultural equipment and other heavy duty equipment; and providing for the repeal of such provisions upon expira- tion thereof PURPOSE OF BILL: To provide a state sponsored Main Street Development Center within the Division of Housing and Community Renewal, which will provide assistance to local governments seeking to revitalize their downtown areas. SUMMARY OF PROVISIONS: This bill directs the Division of Housing and Community Renewal (DHCR) to work in coordination with the Empire State Development Corporation, the Department of State, the Department of Transportation and the Office

HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to requiring a study on the height of overhead utility lines and communication lines as such relate to the height of agricultural equipment and other heavy duty equipment; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public service law is amended by adding a new section 28 to read as follows: § 28. STUDY ON THE HEIGHT OF OVERHEAD UTILITY LINES AND COMMUNICATION LINES; AGRICULTURAL EQUIPMENT. 1. THE CHAIRPERSON OF THE PUBLIC SERVICE COMMISSION IS HEREBY AUTHORIZED AND DIRECTED TO STUDY THE IMPLEMENTATION OF THIS CHAPTER OF LAW IN REGARD TO THE HEIGHT OF OVERHEAD COMMUNICATION LINES OR CABLES INCLUDING BUT NOT LIMITED TO TELEGRAPH LINES AND TELE- PHONE LINES, AND ANY OTHER OVERHEAD UTILITY LINE OR CABLE THE CHAIR- PERSON DEEMS NECESSARY TO COMPLETE SUCH STUDY. 2. THE STUDY SHALL INCLUDE, BUT NOT BE LIMITED TO EXAMINING: A. THE USE OF AND COMPLIANCE WITH THE NATIONAL ELECTRIC SAFETY CODE LINE HEIGHT STANDARD; B. INSTANCES OF VEHICLES, INCLUDING BUT NOT LIMITED TO AGRICULTURAL EQUIPMENT AND ANY OTHER OFF-ROAD HEAVY DUTY EQUIPMENT, COMING INTO CONTACT WITH COMMUNICATION LINES, UTILITY LINES AND ANY OTHER OVERHEAD LINE OR CABLE; AND C. WHETHER SUCH NATIONAL ELECTRIC SAFETY CODE LINE HEIGHT STANDARD IS SUFFICIENT WITH THE INCREASED SIZE OF AGRICULTURAL EQUIPMENT AND OTHER OFF-ROAD HEAVY DUTY EQUIPMENT TO ENSURE SAFE PASSAGE OF SUCH EQUIPMENT UNDER SUCH LINES OR CABLES.
